So, I have a friend of mine who gave birth 6 months ago, she just moved in together with her Canadian boyfriend about 4 months ago, obviously they still have 8 more months to live together before they can apply for sponsorship. Her bf is divorced, about 5 years ago, right now she's still on her mat leave and her work permit just ended but she applied visit visa already. Now, she's worried since her bf has been divorced that they might be questioned or something, do you think having a common child together is a strong proof that the relationship is legit? Of course aside from their pictures and other proofs. She doesnt have an account in here so I thought i could ask for her and give her some advice...Thank you!

Having a child together is better than not having it, however it does not prove anything to the CIC. They will need to have other evidence of them being in a legit relationship.
Being married in the past will not really affect the process, as long as the proper paperwork is in place.

A divorce will not affect the app unless he was sponsored by his previous spouse and then divorced after coming to Canada. Even then, it would only result in a some extra scrutiny of their relationship, nothing serious.

A child can be good relationship proof. However, having a child doesn't make them more likely to be approved than if they didn't have a child.

I just don't get it. Who would have a baby with someone if the relationship isn't real? This is not a game, it's a human life at stake.
I couldn't imagine better proof than that. Especially if the wife is sponsor...
But surely, the history of CIC knows many desperate women who might have baby just to get a one way ticket to Canada. ???

I see. We have a immigration consultant in town and she told her that since they have a kid together they have a better chance of getting approved. Coz they are in a committed relationship not only with each other but with their child..
Anyways, thank you! I hope these will ease her mind...

i think their relationship is legit, she is just worried that her bf's previous divorce might affect their application in the future, negatively...

I didn't refer to your friend. Just wondering how the system works with families who have babies/kids.

I was divorced and married now, so I did consult a lawyer. Nothing changes the application but a few more documents.

Having a kid together will remove Condition 51 from the applicant's PR status (when received). That is probably the main "benefit"

Having a child together does help, as it is very good proof the relationship is genuine. The fact her boyfriend was divorced 5 years ago should not hurt their chances, unless as noted above he was sponsored to Canada.

There have been a few appeal cases where the sponsor lost the appeal, even though the couple had children together. It is not seen as 100% proof the relationship is genuine, but usually it does help.

Unfortunately too many people will resort to extreme measures to get into Canada, that is why CIC won't make it easier for couples with children.

They will definitely ask why there was a child born before moving in together, and also scrutinize anything that doesn't flow in the 'traditional' progression of a relationship. They study everything. But if you have A DNA test it will help.

People do have kids just to increase their chances, believe it or not. I think CIC will be more worried about your relationship being genuine, anyone can have a kid, but proving you are in a genuine relationship is a bit more work.

What's traditional progression? How many couples have first kids, get married years later or don't get married at all. It's a personal choice.
It's pathetic to create a life who would suffer the lack of parental love.
So because someone tried to screw the system for many "real" kids won't be any easy.

I'm just wondering is it same suspicious the opposite case - the wife is Canadian, the kid is Canadian , father is being sponsored. Do the same rules apply?

i didn't say it's necessarily suspicious, having just gone through the horrible interview last week, that is what he told us they look for. Traditional progression would be dating for a while, then moving in together, possibly getting engaged, married, and the having children.

Having a child first before doing any of those other things is not a crime, but it is not the traditional route, and they will look at it. That's all.
