Hello Everone,
I am planning to immigrate to Canada through Epxress entry. My marital status is Divorced and I dont have children. However, I dont have any document to prove that I am divorced.
Is any document need to be applied or just my confirmation that I am divorced is okey ?

You need a divorce certificate. IRCC can't just take your word for it.

A divorce document would very likely include personal information (name, address, DOB, etc) of a third person. What if local laws, e.g. new European GDPR (very strict), forbid sharing information on any person without their written consent?

I doubt privacy legislation can prevent a person in the normal course of their life from sharing their divorce certificate with an entity. It is more likely that the legislation would cover what that entity can do with the information.

Regardless, IRCC needs the divorce certificate to make sure that there is no spouse that needs to be included in the app.

You clearly do not understand what privacy laws are about. The person whose personal data is on divorce document has ALL THE RIGHTS to prevent this information from being shared with others without their consent.

Well, then a divorcee might apply as single (no spouse), problem solved.

Lol, I understand. You are trying to say that privacy laws can prevent a person from doing anything in the normal course of their life that requires their divorce certificate, i.e. get married again, immigrate, do banking/tax filing etc. Under your interpretation, a person must get their ex-spouse's permission to show the divorce certificate in order to get married again. No, it doesn't work like that.

Sure, they can try to commit immigration fraud.

After divorce you can get married again and claim to have never been married. What kind of fraud is that? You are not married and claim that you are not married?

And have you given any thoughts why immigration services need ex-spouse name if the divorce was 20 years ago? Do they run a TMZ shop?

When applying for a marriage license, a person is required to declare if they have been previously married. They can choose to lie but that is fraud, just like lying to IRCC is fraud.

No, I haven't given any thought to it because I really don't care.

And you will see soon that it will.
Oh yeah, because the government is going to make a beaten woman go beg her abusive ex-spouse for permission to show the divorce certificate in order to remarry.

You are allowed to not care, but can you think? What fraud is that when a non-married person (but after divorce) states that they are single? What harm does that cause?

NO. Because the government will not be allowed to ask for information on a third person, if that third person did not consent to share their data. Simple.

Cut the childish attitude. If you need to resort to insults to have a grown-up discussion, take it elsewhere.

Do you know that people lie? Do you know how easy it is to say "single" when you are actually married? Do you understand the laws regarding bigamy/polygamy? Do you understand the immigration rules regarding the inclusion of spouses? Do you know about the laws regarding the admissibility of family members and the Excessive Demand Threshold? Do you know what a Divorce of Convenience is?

Not simple at all, hence why there is no such legislation and won't be for a long time, if ever.

You should be able to get a divorce decree from the civil affairs in your country. If not then you must explain why in writing and attach a signed affidavit of your divorce details in your application.

Hopefully you don’t provide your birth certificate then, as I imagine it would have info for someone else. Did you get their written permission?
