my fiancee and I are planning on getting married next winter and applying for PR outland, with me living in the USA while it processes as I finish my degree. He is joining the army prior to us getting married (in canada) and the chances of the military having housing for us is slim to none as the wait list as the post he will be going to is currently 3 years. My question for you is once the PR is approved, is it necessary for us to live together? I was planning on renting an apartment in the city closest to the base and living there while he was posted with him coming to stay with me as often as possible and on weekends until we were able to get quarters. Is it necessary for he and I to live together or would this arrangement be satisfactory?

Given the information you have provided, you would have "Condition 51" applied to the PR. This means that you must cohabit for the first two years after he landed. Therefore, in theory, your plans are incompatible with the condition. It's unclear where all this is going to happen. Are you intending to remain in the USA or will he be serving in Canada?
(edited after reading your previous posts).

Serving in Canada, hes canadian, I would be moving to him. We were going to file then have me move up and live on my own while we waited for quarters, I suppose we could put his name on the lease if that counts? I dont mind it certainly lol.

In truth, it's extremely unlikely to be a problem in reality. The "Condition 51" is to protect sponsors against applicants taking advantage of the sponsor to gain PR status and then abandoning them. It gives CIC leverage to revoke the PR and deport the offender. It's not perfect but it's a start.
Unless someone actually reports a breach of the condition, it's unlikely that CIC would know, or care.

yea we are trying to find an apartment but assuming its simply not viable for him to live with me because the military tells us to sod off I dont want to have to wait forever to live with him :(

if the military tells him he cannot put his name on a lease and its just my name there would it be a problem?

It's only my opinion but I would suspect CIC would be a bit lenient in this case (if they ever found out) since the OP's husband is in the military. CIC tends to make a few exceptions for government and military folks in cases like this.

I agree. I'm surprised there is no actual wording in the Condition 51 rules that gives allowance to non-cohabitation due to Canadian military deployment or stationing. It would be a public relations nightmare to the government if they ever revoked anyones PR for this.

Its just from my common sense that military will not object to joint leasing an apartment with your husband. I think he can even jointly own an apartment with you.

The arrange that you are suggesting will be of full satisfaction of Immigration...
I would not worry about it....
Every case is different, and deployment is not that he is leaving the nest...

Congratulations on your marriage,
and good luck with your application
