I received a letter from CIC saying that:
1. November 20, 2014 - applied for work permit extension by paper. Applied with no LMIA because (see next point)
2. November 28, 2014 - original work permit expired. I applied before current work permit expired and complied with the conditions of original work permit (meaning I kept working for same employer). So from November 29, 2014 I had implied status as worker.
3. January 27, 2015 - I received a letter from CIC that work permit extension was rejected (no LMIA) and status expired. Letter said I had 90 days to apply for restoration.
4. February 9, 2015 (day 13 out of 90 for restoration) - applied for restoration of status as worker by paper (still without LMIA). My expectation was that by the time application would be processed I would receive LMIA. I wanted to decrease the wait time because restoration is soooo long.
5. March 23, 2015 (day 56 of 90 for restoration) - called CIC and cancelled restoration of status as worker application from February 9 because still no LMIA and processing time was close (did not want to risk any more). I expected to receive a refund for this application because I cancelled it like 20 days before it was to be processed (according to processing times on CIC website).
6. April 23, 2015 (day 86 of 90 for restoration) - applied online for restoration of status as worker because I received LMIA.
Now the problem started below.
7. June 18, 2015 - received a email from CIC that refers to the application from February 9, 2015 and says that I am out of status and have to leave Canada (see quote at the start of the topic). The content of the e-mail was 1 PDF file and here is the link to page #1 and page #2.
Now my question is: do I have to leave Canada? Is it a departure order?
Before you answer pay attention to point #6 - I applied for restoration on April 23, 2015 before 90 days expired and this application still has not been processed. So even though I am out of status I believe I may stay in Canada.
Also reading CIC website here it seems like departure order has a form number and this is how you can tell it's a departure order. My PDF does not have any form numbers so I think it's not a removal order. Anyway I want to check with the community because with such things you have to be 101% sure.
Bottom point: I expected to receive a refund for this application but for some reason I haven't. I think this PDF is not a removal order but I ask you to verify this.
