Difficult Situation

I have worked in Canada without authorization unintentionally. I hired a consultant for my PGWP extension. But he messed up the things as a result CIC rejected my application and did not even gave me an implied status. So my permit expires on May 19, 2015. CIC issued a letter on June 15, 2015 stating that my temporary resident status expired on May 19, 2015 (expiry of my WP). My consultant told me this on July 6, 2015 and I got my employment termination 2 days later.

So my question is if I don't include my experience from May 19 to July 8, 2015, I would not have 1 year skilled work experience for CEC. If I do I may have a chance. So what to do. Would cic consider my work experience from May 19 to July 8 as a authorized work experience because I had my pay stubs and I paid taxed or would it not?

Shall I make my EE profile and let cic know through letter of explanation what happened with me

I am really sorry to say this, and I am not an expert, but I believe CIC makes it clear that the only work that counts is work done legally in Canada. Wait for some other answers, and, again, I'm sorry, but I am reasonably sure that only legal work counts toward Canadian experience.

If you don't include your work experience from May 19 to July 8, 2015 then you won't have the one year since you intend to apply under CEC. Now if you include these dates although you would have more than a year, the fact is that since you were working illegally during this period it is highly unlikely that CIC would count the work experience gained during this period.

This is what CIC says regarding CEC application:
'You are not eligible for permanent residence under the Canadian Experience Class if you gained your work experience:
without the proper authorization (for example, illegally, working without a visa)'

Do you have any foreign work experience that would enable you apply via FSW?

No I don't but the thing is that it was my consultant who screwed up the things for me. Would not CIC consider that? Is it advisable to include make an EE profile and if I get ita I explained cic. What do u people think

Even though you used a consultant ultimately it's your application and hence your responsibility to ensure your application is accurate. I doubt if they care if your consultant messed up.

I agree with that.. CIC wont mind if its your mistake or Consultant's... They are very strict.. :(

Ok thank you very much everyone. I was so closed to make myself eligible and then this happened. There are lot of people here who just charge you and then screwed up everything for you and don't even take liability and return your money.

I met one consultant who is pursuing me to hire his services asking me to pay 20000$ and telling me according to his assessment I am qualified for CEC.

It is just killing me that I have leave Canada. Even though I got an admission in a college but that won't helpe because I have utilized my 3yrs PGWP.

If you have any suggestion on how can I apply for PR let me know please

Consultant will give u big hope in order to get money becaue he knows u r in need, if he gives u some hope u will hire him. On other side, if u have not used ur vacation, than paid vacation gets count towards ur work experience, as u r short of just 12 days for one year, and if u have 12 or more days than that paid vacation , than u r good to go for 1 year of cec experiemce, just dont include unauthorized days u worked in ur experience.

Yes you are right these consultant want to screw you up. However if you read my original post I am not shy by 12 days. I am short my more than a month . WP expired on May 19, 2015, cic issued a letter on June 15, 2015 stating my temporary resident status expires on the same day as my Work permit expiry 19 May 2015. 1 year of work experience would have been on July 1, 2015. 40 god damm days!

If you used 3 years' PGWP, how is it you have less than 1 year CEC?

Can't you come back to Canada on a student visa if you just got a college admission?

If you already know that the Work permit you had is not elegible for extension, and it seems you knew when you submited the apllication to extend your stay in order to get the extra time to get the work experience you needed for CEC, why areyou saying your cionsultant screw up ? As you are many who try to cheat the system and of course, CIC caught the game and is not playing it any longer.
