Deported from USA. Will I be able to apply for Canada.

Hi. My name is Nadeem. I was deported from the United States for stayed too long without a Visa also I have three misdemeanours in duration of 15 years. My parents and sibling are in states they all have green cards. Now my question is that I am about to get married and my fiance is Canadian citizen whenever I will be able to apply for Canada do I have to mention that I lived in the United States for 15 years and if I do. do I have to tell them about my record. Also I been deported with 10 years restriction to re-enter please Sir answer my question I really appreciate it

The deportation isn't a problem. The misdemeanours quite possibly are and it's possible you may be inadmissible to Canada. You should read up on inadmissibilty here and what you will have to do to overcome it (if you are in fact inadmissible): http://www.cic.gc.ca/english/information/inadmissibility/

Yes - when you apply you must mention your residency in the US. Yes - you must also mention your record. If you fail to mention your record - CIC will still find out about it as part of the background/security check and will then refuse you and ban you from Canada for 5 years for misrepresentation.

Thank you thank you so much for replying me as fast as you could obviously that was a quick answer Sir I have couple more questions on the link that you have sent me and I read it it is telling me that if I go to rehabitation I will be able to maybe get my application in a good manner however my crimes are for possession of marijuana Less than 2 ounces. I have two of those and I have a theft case. Which is basically pretty stupid if I explain them it's not even my fault and driving without a drivers license what do you think I can do. what one would you be my next step to do. Do I have to sponge my cases from the United States??

Again, you'll need to provide the full details of your charges. It sounds like you have four charges? Two possession charges. One theft charge (for how much)? And one charge for driving without a license.

For each charge you need to tell us what penalty / punishment you received (fine? probation?) - and when the penalty / punishment for each was completed (what year and what month).

Sure. 1 st misdemeanour theft 2004 less than 500 hundred dollars from a person. That's when I was 18 or 19 years old it's was related to a stolen laptop.
No jail time only 9 months probation which was completed in 6 with all fined paid.


2nd. Possession of marijuana it was a tinny bit of a left over cigar.
1 day jail and some 400 to 500 hundred in fines
2008 or 2009


3rd no driver license maybe couple along fine no jail time license maybe couple of a lot of fine no jail time.

4th.
Now this one should have never happened but got arrested with 11 gram bag of synthetic marijuana actually that was not even mine that was my girlfriends since she started crying so I had to take charge and keep a free but time was wrong for this charge I did 10 days jail time no probation. 2013.

That's about all I have on my lifetime from what I have heard this is minor stuff but I would love to get your professional opinion on this and thank you so much Sir for your support and your quick replies. really feels like I can get support from all the way from 14,000 km away at this moment thank you have a good day

1. Not a hope. You are criminality inadmissible.
a. Theft of the laptop Criminal Code 321 punishment : (b) is guilty (i) of an indictable offence and is liable to imprisonment for a term not exceeding two years, or
b. Controlled Drugs and Substances Act Possession Punishment x 2
(6) Every person who contravenes subsection (1) where the subject-matter of the offence is a substance included in Schedule II
(4) Subject to subsection (5), every person who contravenes subsection (1) where the subject-matter of the offence
is a substance included in Schedule II
(a) is guilty of an indictable offence and liable to imprisonment for a term not exceeding five years less a
day;

You aren't eligible to apply for rehabilitation until sometime in 2018.

You'll need to apply for rehabilitation once 5 years have passed since you completed your jail time for the 2013 conviction.

No - you cannot.

You are inadmissible to Canada due to your crimes and will be deported if you attempt to claim asylum here.

Again - you're inadmissible to Canada at this time. This means you cannot enter Canada for any reason.

You must apply for rehabilitation and rehabilitation must be approved before you will be allowed to enter Canada. However you won't qualify to apply for rehabilitation until sometime in 2018.

Canada is not an option for you at this time and you cannot come here. There is nothing you can do to change that.

As Scylla pointed out, you are criminally inadmissible. Having an Uncle in Canada won't help. You will be detained at the border and returned to the US. Remember that Canada Border Services has full access to your immigration status in the US, so they will know all about your situation.
