Hello everybody. I have some questions regarding dependent children.

My family are going to start their application to immigrate to Canada (my father is the applicant).
I am a university student and I'm unmarried. And so I can be a part of their application as a dependent child.

My question is: How long do I have to be a university student? and how long do I have to stay unmarried?

I've heard that ONLY at the start of the process I need to have dependent child's requirements and I can get married or finish my education after we start applying for immigration. Is that right??

Can you guys help me with that?

How old are you now?

If you are 21 and under, then you are locked in as a Type A dependent upon submitting the application. In this case there is no requirement to be studying full time. However you can NOT get married/become common-law, until the entire application is finished.

If you are 22 or over, then only if you are enrolled in school FULL TIME since age 21, can you be a Type B dependent. In this case you must STAY IN FULL TIME STUDIES during the entire duration of the application processing. If you end your studies or even drop to part-time studies, or get married/become common-law at any time before getting PR, then you are no longer a dependent and will be removed from application.

So in both cases you can't get married/become common-law until you have your PR status.

Isn't there any way so I can get married and still considered as a dependent child? Cuz what you said is so unfair. The fact that we're going to apply for a PNP application, and it takes about 3, 3.5 years...

Since you're over 22 - you must remain in school full time and must stay unmarried to be considered a dependent child until you land in Canada and become a PR. Those are the rules. No - there is no way you can get married. If you get married - you will be removed from their application.

As Scylla said, you can't get married/common-law until AFTER you get your PR status. To do so before would immediately disqualify you as a dependent.

Also you must stay in school FULL TIME right up until you get PR.

Finally, there is a proposed rule change that may happen at any time, that will change dependent definition to a person aged 18 and under ONLY, with NO clause for an older person in school. If this change happens before your family can submit the PR application, then you would not qualify at all even up-front. Nobody knows except CIC when this new rule will be put into force, so I would try to get your app in asap to make sure you qualify.

Yes, as long as it's full time study, and you depend mainly on financial support of your parents.

It means if you don't get your app submitted before August 1st, then with the new definition of "dependent" you would simply not qualify to apply anymore.

Age is being reduced to 18 and under, and there is NO allowance anymore for older people in school.

I had applied for dependent visa as my spouse is studying but got visitor visa with single entry. Can I change my visa condition and apply for open work permit in Canada.

Yes, if she is studying in a recognized school for longer than 6 months.
