Dependent Child over 22?? [solved]

Hello,
I wanted to know that If a dependent child over 22 was studying full time and fully dependent on his/her parents at the time the parents filed for Permanent Residence and added him/her as their dependent.

So does he/she has to continue his/her studies continuously until the application process is ended to keep their dependent child status?

what if the course they are enrolled in ends before a decision is made on the PR application?

do they have to continue their studies further or what?

I read alot of documentation and found out that


the dependent must be studying since before the age of 22 and at the time of submission of the application and must stay enrolled though the whole process, however long it is, until VISA is issued.

Unfortunately no he or she will not be able to be sponsored by your parents.The rules changed in 2015 and it doesn't matter if they are studying full time . The only way a parents can sponsor over 22 is if the dependent has some disability and is a dependent .

The rules may change again with a new Prime minister there is talk about is going back up to 22 but over 22 he/she still wont qualify

If the parents submitted their PR app before the rule changed, then they would be grandfathered under the old rules for dependents as long as that original app is still processing.

However under those rules, a child aged 22 or over but in full time studies, will only be considered a dependent as long as they maintain enrollment in full time studies. As soon as that stops, they are no longer a dependent and must be removed from the application. So it might be worth it to continue their studies until the app is approved.

If the PR application was submitted before the age rules were changed, then the dependent child must remain in school full time without a break until a decision in the application is made. If the dependent child stops attending school before a decision in the application is made, they can expect to be dropped from their parents' application.

I believe that as you are a legacy Type B dependant, you may not need to remain in study for the entire duration of the application. http://www.cic.gc.ca/english/information/applications/def-dependent-child.asp

Thank You everyone for the help.

My parents PR application was submitted before rule change and I was over 22 at the time when the application was received by them.

Why until now there is no clear news or decision on the changing of dependent child age to 22. I hope the immigration minister orjustin trudeau will look in to it again as promise.
and pls lets all make a noise to raise our concern.

Hi,

That’s so important for me to find the answer, previously thankful for helping.
What is the exact definition of a dependent child who is eligible to be sponsored? The definition of immigration site for children over 22 is not clear.
I worked for a few years after 22, but always supported by family for housing. I’ve been unable to work for some time due to mental condition and mom supports me. Am I eligible to be sponsored by her? Mother & two brothers are in Canada & father is deceased.

Will POF still be provided for such child over 22 years that is ineligible and not travelling with the parents?

Secondly, assuming you have another child that is eligible (ie below 22 years) but she's not going at all (either now or later) with you. Would you still need to provide POF for such?

I don't really understand your question then. If a child is over 22 years of age, they're considered independent. Of course no proof of funds.

For the child under 22 - it likely will depend on what you're applying for. There are no formal proof of funds requirements for spousal sponsorship.
