Hi I NEED HELP

Failing to comply to residency obligation resulted to issue departure order against me about 15 days ago , my questions are
What are the chances of having successful appeal ?
How long does it take ?
Does it need lawyer ?
How much does it cost ?
Being my son born in Canada , how does it help ?

1. I assume that you have submitted the appeal, or will submit it before the 30 days are up.
2. It depends on how many days you were short of the residency requirement and the reason why you remained overseas.
3. Probably a good idea to discuss the appeal with a lawyer and then make decision where to hire him/her or not.
4. Probably a year before it gets to the appeal stage.
5. No, the son won't make much of a difference.
6. You may want to go to http://www.canlii.org/en/ca/irb/index.html and search on residency obligation to give you an idea what the appeal board looks at.

Hello Cosmopolitan,

If I may ask, how did you get your departure order? Was it upon your arrival into Canada at some port of entry or did you receive it because you applied to renew your PR card without meeting the residency obligation? Which port of entry did you enter if you got the departure order upon arrival into Canada?

I understand that u have difficult time and looking for advise on forum, we would appreciate if you will share with us how it is came, since many of us did not meet PR obligations and still working in oversees. Are you from BC?

Thanks in advance.
