that CIC would reject lots of pending applicants but that turned out to be false as CIC has apparently opted for keeping the Applications on their hands , changing the Status from RbVO to IN PROCESS, , making the application fees non refundable; having regular interests from the fees. it has all turned into a money making game.
 
Hi Friends, I am new to this thread. I had my application since jan 2011 and I am just waiting for passport to be returned with Visa. I am scared coz my ecas shows exactly the same as Pearl's. I was alarmed when I read Pearl's situation. I saw my ecas changed to "Decision Made" last week until now my consultant has not given me any update. Should I be more patient or when a decision has been made, do they usually say in your ecas your visa is stamped or you are accepted? Please enlighten me. Thank you so much.

I agree. If you can demonstrate how the original reference letters match the various elements of the NOC duties and show you match x% (more than 50% at least) of these, and also demonstrate how these reference letters show you match the lead statement, then I think you have a good case for appeal.

It is important to demonstrate how you feel you were eligible with the documents sent to CIC originally, and not with any new documents you might want to send, since they will not consider extra documents after a decision is made. In their letter they did not say that they were refusing the application because the reference was word-for-word the same as the NOC description on the HRDSC site. They simply said that the references were not adequate.

Since 0213 is no longer on the in-demand list, I suspect they may reject the majority of borderline cases for this NOC which might otherwise succeed for applicants who are on the list. They probably think that most people won't bother appealling and will simply accept the rejection - so if you have good grounds for reasonably demonstrating you are eligible, it is certainly worth appealling.

Rightly said Wayne.... I am also from same NOC & now started suspecting a similar fate of my application. Since the NOC is no more in demand. They can fetch out even a minor descrepency to refuse.

Still this is not justified making people wait for such a long time & then refusing.

Dear Pearl, I guess all in NOC 213 must be curious to know 2 things.

1. What hapened to the appeal for re-consideration of your application ? What is the response received from CHC ?

2. I am personally keen to know (don't know about others) a brief details of job duties mentioned in your husband's application. If you can detail them, then people of similar NOC can inject another letter signed from their vertical in a more elaborate form to appease the VO. Indicating additional responsibilities assigied to them over the period of time.

In my case I had already been assigned additional duties by merging regions & teams. This thus increased my area of working & number of associates reporting into me & I have already planned to inject a new letter. I just want to modify & elaborate my job responsibilities.

I pray from the core of my heart that your appeal for reconsideration is accepted moves ahead to next stage & gets you maple leaf visa finally.

is it possible for you type or copy the JDs mentioned in your reference letter over here...that will certianly give everyone a better picture of what happened and why would a VO doubt its not enough......

CIC would be playing a very dangerous game if that were the case. If they failed a case during processing, for a reason which was apparent prior to processing, just to try to keep the processing fees, then they would be on very shaky legal grounds and probably liable for prosecution in my view.

Honestly, I don't think this is an avenue which CIC would go down. If it is apparent that an application is ineligible then in my opinion they will simply fail it at the eligibility review stage.

Sorry for not replying to many of your queries,I didnt check this link for a long time.

We emailed LA office to know the feedback about our appeal letter around 1st week of August and again it was 'negative'.
here is the actual reply,
Dear Sir,

Your application for permanent residence in Canada was considered on its substantive merits and was refused. You were provided with the decision containing the reasons for refusing your application for permanent residence in Canada, by letter addressed to you dated ---, thereby fully concluding your application.
Should you have different or additional information, you may wish to submit a new application for permanent residence in Canada.

Canadian Dreams,haral-->The original exp letter had the total yrs of experience,positions held,timeline of each position with duties & responsibities in detail, salary details, and working hours.
Canadian Dreams-->I dont think u should send any updated exp letter now,bcoz we dont know what is going on with our applications and sometimes a positive decision may have already been made on ur application.so pls hold on to it.

If u see our time line, my husband had applied under 0213 on Dec2009 and everything was smooth till last Tuesday (31May) when our ecas changed to Decision Made. As such, I am not satisfied that you are a Computer and Information Systems Manager, NOC 0213.
Since you did not provide evidence that you have work experience in the listed occupations, you do not meet the requirements of the Ministerial Instructions and your application is not eligible for processing

In fact, my husband had provided the original work exp letter with all the duties & responsibilities related to his exp as a Manager. Most of the duties & responsibilities in the original exp letter were same as the ones he had mentioned initially in the work experience column of the CIO-Sydney form .my question is, when the same points were considered eligible by the CIO-Sydney visa officer, what made the LA visa officer to reject when we had provided the original exp letter including the same points. Moreover, there were many constraints in obtaining the original exp letter.

Now he is planning to write a detailed re-consideration letter against the points of the Visa officer and he will be highlighting the CIO-Sydney point too. Also, I need valuable suggestions & prayers from all the forum friends to make this a positive turn.

Now, to whom should we address to? In some instances I have read ‘address to the Program Officer', who is the program officer? Is it the same visa officer or some higher officer?

Another important query...My husband has been writing research articles and has been published in online journals. Can this be mentioned in the re-consideration letter as this is purely technical in nature and they might not consider him to be a manager.

how about Federal Court????.......... no need to believe that VO is always right........ if you believe he has made a mistake .............fight for ur right ............. people have .....and....... they won!!!!!!!!!!

I got a rejection letter stating that i did not provide a conclusive proof of my relationship with my my brother in Canada or that he was resident there.

The Visa Office requested for a copy of my brother's PERMANENT RESIDENT CARD and MY BIRTH CERTIFICATE which i did provide. I therefore do not get their argument at all.

I want to write a RECONSIDERATION LETTER given that the judicial process is damn expensive for me.

Guys, what more evidence should I attach to this letter? I intend to include the following;
a) A copy of my birth certificate (again)
b) A copy of my brother's permanent resident card (again)
c) A copy of my brother's birth certificate
d) A copy of my father's death certificate (given that I can't trace his birth certificate)

Any suggestions will be highly appreciated.
