Yup... As per information provided in multiple forums my understanding is: they will issue a letter that you are refused to enter in US due to administrative reason (no side effects for future travel as clarified above :) ). You will go back and provide this letter to Canada officer and all set.

Members, Please correct if i am missing anything here.
Awesome - thanks!!

Congrats Bommas! :)

In FlagPole process, Do they put any reject stamp or anything similar on passport for refusal of entry in case of not having proper US Visa?

Hi CEC122014,

Thanks :)

No, there is no stamp of rejection on Passport. They give one letter stating that you are rejected entry to USA (checkbox ticked) & the officer has written manually "Flag Poll for Canada PR" with name, dob, passport number.

Wow. Today, I paid the RPRF and got the refusal. What would happen to my RPRF payment now?

FYI, I had finished my graduation on December 14, 2012 and claimed work experience from December 20, 2012 to December 20, 2013.

I want to request to re-consider the decision. How can I proceed?

I also had provided the college letter that says I was graduated on December 14, 2012.

I am not satisfied that you meet the skilled work experience requirement based on the information
provided. In support of your stated work experience, you provided a letter dated 2013/ 12/18 from <My employer>, stating that you worked as a Quality Analyst from 2012/12/19 to 2013/12/20
which is the lock-in date of your application. This letter of employment from your employers did not
satisfy me that you have completed one year of skilled work experience in a NOC 0, A or B occupation
prior the submission of your application because our records indicate that you were only given your post
graduate work permit on 2013/03/20. You have held full time student status prior to the lock-in date
(2013/12/20) and you are therefore not eligible to claim work experience before this date.
As such, you do not meet the work experience requirement of the Canadian Experience Class

Sorry to hear this but why did you apply if you knew you were not eligible. I can imagine your loss and frustration but I am just curious if you were just trying .....because for CEC you need 1 year experience in Canada. Please help us understand your case if you would like. If not, I am really sorry to hear this. Hope you can re-apply and get PR immediately.

Good Luck

I am sorry. I should have mentioned that I was graduated in December 14, 2012 and I claimed the experience from December 20, 2012 to December 20, 2013. I had also provided the letter from the college that I have graduated on December 14, 2012.

Now, I want to request to reconsider the decision based on my the fact I just gave above. How can I do that? What happen to my RPRF payment?

Based on the explanation from officer, You got your PGWP on 20 Mar 2013, then could you please clarify how did you work from Dec 14 2012 thru Mar 20 2013?

I had OCWP and I was allowed to work full time after my graduation i.e. December 14, 2012.

Sorry to hear your case.. As far as I know the work experience for CEC only starts from the date that PGWP issued but not when holding OCWP...

Sorry to contradict but that is not true. I have real time example who claimed that experience and got PR. In fact, before applying, I discussed with two lawyer and called CEC 3-4 times to confirm that can I claim and they all said yes. But couple of CIC call centre guys told me that I can not.

So who knows....this had to happen to me....I am not happy because I know people who claimed that experience and got PR.

Dude don't loose hope. Try again. You will get your rprf back. You have all the necessary experience now...

If not reopen the file. Not sure of the procedure though. Maybe some seniors can shed light.

Sorry to hear it :( Did they request your RPRF or you just paid it and co-incidentally got refused at the same time? They will refund it afaik.

I paid by my-self with the thought they may slept on my file and this will poke them to check it...LOL

And they poked me... :P

Also... I don't know which lawyers you spoke to, but maybe those others got lucky, according to cic.gc.ca:

Who cannot apply for permanent residence under the Canadian Experience Class?

The Canadian Experience Class is for people who already have skilled work experience in Canada.

You cannot apply for permanent residence under the Canadian Experience Class if you:

gained your work experience without the proper authorization (for example, illegally, as an undocumented worker),
gained your work experience in a job not classified as skill type 0, or skill level A or B according to the National Occupational Classification,
gained your work experience in any of the six ineligible occupations: cooks, food service supervisors, retail sales supervisors, accounting technicians and bookkeepers, administrative officers, and administrative assistants,
gained your work experience while you were self-employed,
gained your experience while on a student work permit (co-op, off-campus, or on-campus), or
have less than one year of full-time (or an equal amount in part-time) skilled work experience in Canada.

Canadacec123: Here is a grey area. Once you graduated your study permit become invalid and you become in transition from study to work. and it is legal.
