Dangerous Driving with Conditional Discharge for a year

Hi everyone,

I got charged for,

1. Impaired operation. 320. 14(1) over 80

I was on a post graduation work permit in Canada and am now on an open work permit extension.

My crown has given me a guilty plea to Dangerous Driving for a Conditional Discharge with 12 months’ probation not to operate a Motor Vehicle and 12 months’ driving prohibition.

I am eligible to apply for permanent residency now, and I am in the express entry pool (CRS 463). My question is whether, more likely, I am going to have one year of probation with driver's prohibition.

Can I apply for permanent residency after completing my one-year probationary period, or can I apply at any time? This is the point at which I am unsure whether I can apply for permanent residency.

Can I extend my work permit later if I need to because it’s expiring in September 2024?


Because, based on my research, it says a conditional discharge would show on my record for 3 years. However, it is not a conviction.

If anyone has had a similar situation or has any advice, it will be much appreciated.
