I've been in canada for almost two years now.
I sent my PR paperwork in around june 1st of this year under Family Class Sponsorship, and was mistaken on the inland application wait time for 1st stage approval.
I want to apply for a work permit, but I want to make sure that I'm ok to apply for one without 1st stage approval.

I was looking at two different forms, but am unsure which one is the correct one to do.

Would this one [IMM 5708] be the correct form I need, to apply for a open work permit from within canada?

Since you did not include the OWP with your Inland application, you must now wait until you have AIP (Approval In Principle), before you can submit one.

I think you will need IMM 5710...sometime late next year, since it'll will likely be that long before you get AIP.

If you are an American, you might consider withdrawing your inland application and re-applying via an Outland application (which you can still do, even if you are IN Canada). You'd probably have your PR long before that!

Dang, really?
I told her I should have sent that in with the package :D
We didn't have enough money at the time to apply for the full package + OWP.
But alright, so no go on the work permit till AIP then?

Would I get any of the money back from the original application then?
I might just do that, if we were able to get the application fees back and just re apply.

Nevermind found it.

If you currently have legal status in Canada, this should be a no-brainer!

Unless you have `red flags', such as criminal issues, or there are questions regarding your relationship, your NEW Outland application would probably be processed in Canada (Ottawa for stage 2, not LA or NY) and you could be an official PR of Canada by next Spring!

Good luck!
