Hi all,

I've just applied for the outland sponsored perm residency (I'm the applicant and my partner lives here in Canada) and I'm hoping they will open my file within a month.

I'm thinking of going back home to visit my family in 2 months but I really don't want to risk not being allowed into the country at the border on my way back.

I mean, the app will be in process by that time for sure, but what should I say at the border as the reason for coming??
Can I just honestly tell them that I want to be with my partner while waiting for my perm visa? Because I WILL have to expand my tourist visa in the meantime, no way they're going to process everything in 6 months. I don't mind it, money is not a problem, I'm just afraid they won't believe me and they will think that I'll try to overstay or work etc.

Plz advice~ ???

If I were you just stay there with your partner.it so hard to losing up some files they will havesent go you

Do you need a visa to enter Canada? if so I would not risk leaving if you want to remain with your spouse, Getting a Visitors visa once a PR application is filed is hard.... it would be alot easier just applying for the extension while here in Canada... If you don't need a visa to enter Canada there are ways to prove your intentions....
 
Thank you for your replies.

Polish citizens don't need visa so if everything goes well I could get max 6 months of visitor status after my return.

I understand that it's always better not to move from Canada but one of the reasons I applied outland and not inland was because I didn't want to be stuck in here for the next 1,5 year without the possibility to travel.

So I should prove somehow my ties with the homecoutry? Isn't it a bit strange as they will know I'm in the process of applying for perm residency and obviously I will want to stay in Canada with my partner in the end?

Even if, what kind of proof for that could I give? The only thing, except my family and friends, is the apartment I still own back home. But surely it's not going to convince them that I'm going to go back in a few months just to wait 2-3 months more to come agani to Canada after the process of my PR is completed~?

Confusing~ ???
 
Since you are from a visa exempt country just have your husband meet you when you come back, he needs to speak to the IO @ POE, have your marriage certificate, any copies of things you have proving your application has been filed... IE... copy of receipt showing PR fee's paid, copy of receipt for courier that delivered your appilcation to CPP-M, copy of sponsorship approval letter if you have made it that far. Your husband will need to let the IO know that you are his wife and that he is willing to support you until you hear about your application. and you would like to request a Visitor's record which is usually issued for time periods of longer then 6 months, usually a year...

If having my partner waiting for me on the border is going to solve the issue then no problem. :)
I'm happy that there is such option for me to actually receive a tourist visa for longer than 6 months when it's obvious I'm applying for the sponsored PR, makes sense. ::)

Has anybody met their partner/spouse at the airport/POE before?

Can my partner be allowed to enter just to pick me up/ certify for me? Or he can only pass the message to the officer?
How does it work?

I'm asking as I remember that the immigration offices were not near the exit of the airport at all (Montreal) so I'm not sure how my partner (who will be in Montreal) and I (who will be landing) can meet together with the immigration officer there... ???
 
everything creampop said is right on the money.

i'm from a visa exempt country (US) and i've crossed back and forth twice since submitting our application, and as long as you have a marriage certificate and proof that your application has been filed, (we showed the canada post tracking, and a copy of my receipt paid) you will have no problems as long as you spouse vouches that they can support you.

by the way, i was given a year visitor record. we're actually going aboard again for our honeymoon in november but the IO said as long as i have the visitor record with me when i travel and the same proofs coming back into canada, it should be no problem at all. i understand that the VR is no guarantee to be let back in, but if you've established honest credibility with immigration they'll let you in.

Your partner will not be allowed to enter the immigration area to pick you up / certify for you. Your partner also won't be able to pass on a message to the immigration officer. The only way you can meet together with the immigration officer is if your partner flies into Canada with you.

Now that sucks, doesn't it. :(

Eh... I guess the only way is to take all docs with me, phone to call my partner just in case and pray it's going to be enough.

That's not very professional way of taking care of things. It should be clear and stated and not hoped and prayed for.

I have entered into Canada on several occasions where the IO didn't buy my story even tho it was truth... and the IO's have called him to verify (once the IO asked for his number another time I suggested the IO call him), make sure you have all the documents, husband have a cell phone? let the IO know even tho he did not fly in with you he is there to pick you up if the IO seems to be in doubt it would not hurt to suggest he call him on his cell phone. not all are buttheads LOL GL!

I am also Polish and will be applying for common-law sponsorship with my Canadian partner soon :)
I can see your application will be processed by Warsaw and so are we planning to do.
We have been living together for over a year and before that we had had a long distance relationship and have proofs such as tickets, skype conversations, email, photos. The thing is that now my work permit did not get extended and I could be here only as a visitor with no right to work for over a year, thats why I was planning on going back in the meantime for work and we would be visiting each other.

I was wondering if you could help me on this important question: do I have to be here in Canada while the application will be processed[/b] (Mississauga and Warsaw)? I mean, would my absence not jeopardize the common-law?

You do not need to be in Canada when you apply, apply Out-land this way since you are from a visa exempt country you can still freely cross the border you and your spouse could visit every weekend if you could afford it. You have already put in the time, all you have to do is prove it, your name on lease or a letter from who you were staying with, like if you stayed with your spouse's parents. Also letter from friends and family stating they know you have lived together for a year and are in a you are in a genuine relationship. You and your spouse should sign the Statutory Declaration of Common-Law Union (link below) and have it certified. even once you apply save all tickets etc for visiting this way if they ask for more proof you will have things to provide.
