hello guys,

i am 2 days short of 12 months work experience, but i have sufficient work hours (40hrs / week). Landing and exit date is more than 12 months..

will this be a cause for rejection ? is it worth giving it a try , please advice.

Sorry to say but chances are it will be rejected. It could be worth a go, but if the letter of employment clearly states start and end date (which is required) then they will reject your application. If you are still on a Visa a few days in a new job could solve your problem!

If it is just a 2 day missing, you have no option to wait (got laid off, work permit expired, etc) and everything else is in order (reference letter, IELTS, NOC category/description) I would give it a try. This is my personal view and not a legal advice...:)

VOs are very strict with experience letter. There won't be any tolerance. So it is like buying a $550 lottery. I won't recommend applying without complete one year exp.

I would advise against it. The last thing you'd want to do is to give the VOs a obvious reason to reject your application.

Hi,

What I would advise is to apply to renew your work visa before it expires. Now, even though that application is rejected, you would be under implied status till that decision is made, which would typically be over a month. During implied status, you will fall under the same laws of your work permit, at least until they give you an answer. This way, you'll complete your 1 year work experience legally. Good luck

Lol - rogerspr - as you can tell from the rampant speculation, the lack of details in your post encourages people to make up their own :)

Can you please explain the following -
1. It sounds like you have left Canada, is that correct?
2. What are the exact dates of your work experience in Canada? (not your work permit, your start and end dates)
3. Did you obtain your Record of Employment? If not, you should do so and see what dates are listed on that. Read here (the section at the bottom - for Employees).

yes ih ave the record of employment and these are the exact dates monetioned on it..

ALso, i have another question - will i loose the $ 550 if my application is refused?

i have close to 2000 hours of work exp though...

do u think its worth giving it a try ? please advice.

On your reference letter or Letter of Offer from employer (If you have these) what are the exact hours mentioned. Is it 37.5 or 40 hours per week?

I would suggest you to still apply (again this Is my opinion) the VO's are not public enemies and some are lenient. Just cos u have 2 days short doesn't mean ul surely be rejected nor does it guarantee that u would be accepted. You would only know once u apply for it.
If you wish to take your chances MAKE SURE U WRITE A NICE COVERING LETTER EXPLANING HOW BY A TAD OF 2 DAYS YOU CAN ENTIRELY LOSE YOUR CAREER PATH IN CANADA.

CIC does not give any documents or fees back once they start processing.
You not only have to pay $550 again, but also get new copies of IELTS, letter from employer, police certificates etc as they are the originals

I see that Oct 3, 2011 was a Monday. you can try to get your employer to mention the start date as the previous Friday i.e. Sep 30, 2011
you are just one day short..

Infact you worked 365 days.. the Feb 2012 had 29 days (1 extra day).. but I'm not sure how they count the 1 year (could be 52 weeks or 365 days too right?).. I'd say try calling CIC

I am in the exact same situation. I started my job Feb. 6 2012 and my employment letter said I have completed 12 months of full-time work (but the date on the letter said Feb. 4, 2013)....I think it is basically a day missing since I started Feb. 6 so Feb 5 would give it a 365 days. So, My letter also said I am in a permanent full-time position with 42.5 hours/week.

Anyway, I already applied in Feb. 2013 after getting my job letter and my application stated Feb. 3, 2013. My application reached Sydney Feb. 8, 2013 and I got AOR in March. Now, ECAS shows application received (not processed yet). I will let you know my status ;)

Hopefully, I get approved and get the PR soon :D Good luck guys.

I think these people are not unreasonable. What more could you have learnt in 2 days that you didn't already learn in 364 days? If there is no way of you gaining the extra 2 days, I would put through the application - yes you gambling $550 but chances of them accepting are much higher than them declining. And if you count the actual number of weeks on the Calendar, you will find that you have 52 weeks and 1 day because some months have more than 4 weeks.

hopefully it should be fine. but I always advise applicants to give yourself some room when it comes to the days you worked (370 days sound a lot safer than 364 or 365) to avoid nerve racking conversations such this one.

Hey johnny
these guys must have had their contracts completed or must've been laid off. So there is very little these guys can do inorder to give more vacuum for more number of days than just 365.

Potgoa and Rogers - Y exactly do u have few days less?

CEC has very few requirements.

But the 1 year job experience requirement is the most important one.

Also it clearly states:
"According to the Immigration and Refugee Protection Regulations, applicants in the Canadian Experience Class are assessed on the basis of the pass/fail requirements set out in subsection R87.1(2). The assessment of these criteria determines whether a worker with Canadian experience will be able to become economically established in Canada. The criteria are:
· knowledge of English or French
· Canadian skilled work experience
"

It is pass or fail, they wont consider. Those officers work like a machine. You get the idea.

If you have no future possibilities of working in Canada again, then I would say go ahead and apply for CEC.
If you are coming back and starting a job again, then I would say, work for maybe 2/3 months, and use both reference letters (previous & new) to add up any missing days.
