Hi everyone!
We're still awaiting our confirmation, but I have a question for everyone. My friend is planning on sponsoring her boyfriend to come to Canada. They've been together for several years while she was living in Europe, she's Canadian and he is from England. The longest they've lived together was 2 months. I've recommend that she document everything. But, what are the best ways to ensure his application is successful? They have not started the application process yet, but they have a lot of communication back and forth, plus her flights to England and his flights to Canada. I know Conjugal Partner applications are much more difficult to prove and not a priority with the government, but does anyone have any information on successful applications and what kind of information/evidence they included to make a successful application?

More than communication evidence is needed, for starters. There has to be evidence it is a "marriage-like" relationship, so to every extent possible they must have combined their lives, it must be clear to their relatives and communities that they are a couple and there can't have been any other parties they had relationships with outside of this one. Financial and emotional support must also be evident. Have your friend look at OP2 starting at section 5.45 regarding the definition and assessment of conjugal relationships.

Also, you can search this forum for a user called "Allyson" (I think that is the name), she successfully did a conjugal application between an American and a Canadian. Her posts should prove informative.

That info is for 2006, isn't there anything more up-to-date? Strange. I tried searching for 'Allyson', but no luck. I will scour through all of the info in the forum to see what I can find. Thanks again!

IMHO there isn't a chance that a conjugal application will be approved. There is no bar that you two can't live together for a year so you can sponsor under common/law. There is no penal barrier nor I assume no barrier to marriage. You should read: http://www.cic.gc.ca/english/resources/manuals/op/op02-eng.pdf starting at Section 5.45

I agree that their chances are very poor. As stated above, conjugal partner class is reserved for people who CANNOT live together due to extreme barriers (eg. same-sex illegal in country of residence, not allowed to visit due to country restrictions, etc) or cannot marry (eg. married previously and divorce from current partner illegal therefore cannot marry new partner). The fact that these two can visit each other (and have) means that "technically" they COULD have lived together for 12 months (eg. 6 months in one country, 6 in another, etc) or married without barriers and thus have just chosen not to. While it may be impractical for them to do these things (common-law or marriage) for several reasons (work, school, family, etc), Canadian immigration will not consider them for conjugal class because they could be together (if they were willing to sacrifice) but have chosen not to for convenience.

Even couples who MEET the criteria for conjugal partners (CANNOT marry or visit each other) are often denied. So someone not meeting the criteria (COULD marry if they chose) has very little/no chance of success, in my opinion.

Don't shoot the messenger (lol) - it's terrible.. I get it and I wish there was more hope. My common-law and I just barely lived together for a full year and if we hadnt been able to, we too would have been conjugal partners with no hope of success... I wish there was a better answer for them, but they may have to bite the bullet and start racking up their common-law hours or get married when they're ready and apply then.

yes our immigration consultant told us only 2% are approved, so it is incredibly hard to prove.

I suspect CharlieD10 was referring to AllisonVSC, who was sponsored as a conjugal partner. Take a look at her posts and consider PMing her - she was still around recently and has been helpful to conjugal partner applicants :)

no one is saying you can't try or that you won't even success were just saying the odds 1/100 even 2/100 suck!... and I sure as heck wouldn't want to toss $1040 bucks to the CIC without doing it the proper way. and just because you think it will go thru doesn't mean you will convince the IO... are you or your conjugal partner married and unable to get a divorce? are you or your partner being denied over and over for visa's to visitor each other? or stop you from living together for a year to be able to apply common-law? if the answer to those questions are no then you prolly have 0% shot.

I have read the post you posted and they have the right to apply common-law, she is from a Country where she can't get a divorce and it is very very hard to get an annulment, see thats the barrier we keep mentioning to you....
