Mikeymyke, I think we have been approved on the 5th try based on the request for passport. I am not getting too excited yet until we get the passport back with the visa.

The situation did change every time we applied. The 5th time, the only thing different is that we have made the PR application. We are able to demonstrate that we have the funds and flexibility to fly back and forth to Asia as required. Maybe our outland application finally convinced them that we never intended to overstay on the TRV and apply inland, which I understand is an undesirable for the CIC as it should be.

Usually filing an outland application makes it harder to get a TRV, not easier. Demonstrating funds and flexibility is not the big thing CIC wants to see, but proof of strong ties for your wife to her home country (full-time employment, mortgage/lease agreement, etc). If you included that information, it is likely that which convinced CIC to grant a TRV.

mikeymike is much more knowledgeable than I on this subject so I defer to his wisdom.

Update on the TRV. My partner received her passport back on Sunday with single-entry TRV. At least we will be able to spend the holidays together in Toronto. We hope she can stay for as long as granted, unless we get passport request for the PR from Manila sooner.

I know that is an option, but we will return to PH. We committed to follow the process, so we will return and re-apply for another TRV if no PPR is on the horizon. If we are granted 6 months at entry, that will give us until next May. Our flight is booked for next week with a January return.

I know the conjugal application will be difficult enough. If we get no PPR and are able to stay in Toronto for 5 or 6 months, we will re-apply for another TRV as soon as we go back to PH. If it comes to that, I will write in the purpose letter that we know the conjugal application is a difficult assessment and by granting us another TRV you may allow us to get to the 12 months living together for common-law status. If they gave us a multiple-entry visa like they did for you I wouldn't mind if they sat on our application with no PPR for a year.

You don't necessarily have to go back to PH though, you can apply for her visa extension while still in Canada and she would only have to leave if that is denied. It's completely legal and there's less risk that way, you will know right away if she can stay long enough to qualify for common law and wouldn't have to spend the money for more plane tickets.

Hello, we are in a similar situation and i understand how difficult is your situation. I am a transgender living a full life as a woman in the Philippines and my boyfriend is a Canadian. Currently i am in the Philippines. I am also hoping to apply for Permanent Residency under the conjugal category.The difference between our case are quite a few. i am happy that you are granted by trv this inspire me

That is a good suggestion. I think we would like to be able to return to PH for other reasons too, but would have to weigh the risk of them not granting another TRV. Ideally we would like to have the multiple-entry TRV which would allow us to travel to other places and return to Canada (e.g. Costa Rica, where visa not required). Applying for the extension will at the very least give us some options.

I don't believe we had any chance of getting the TRV until we were able to file the PR and receive sponsor approval. By doing so we demonstrated our intention to proceed with an "outland" application which will require my partner to return to PH when she receives a PPR. You may have the same result after you and your partner (you better move past the boyfriend term) make your conjugal application.

As far as I can tell, our application and the entire process was handled like any other. As far as timelines we are ahead of many August 2014 applicants.
