I feel like I only have this case/situation in some point :(
I'm presently here in vancouver Canada..
I met my partner when we were in higschool 12 years ago, then in 2010 started talking and entered into relationship. We decided to see each other, so i went to singapore(thats where he works) but he's a Filipino citizen. To make the story short, we have a child(born here in canada). We want to be together, but here's the case.
1. He has a previous marriage, so legally he's still married. However, his annulment is in process.
2. We havent lived together for 12 months to be classified under common law relationship, but since 2010 we do see each other(i/me & our baby went to singapore 3x already, longest time is 6 months)

My questions are;
1. Can i sponsor him as conjugal partner?
2. We have a child in common, do you think we have more chance getting accepted?
3. Should i pursue the application and try our chance?

Here's one more factor that I think will "affect" the application if ever.
I'm currently unemployed because I'm in school right now, but my partner has a reasonable income
in singapore. So he is supporting us financially and our kid and I are living with my parents so they're helping me.

Please advise.. Thank you..

Hi,

Please know that your are NOT the only person in this type of situation.

You will find many people here that truly want to help you and will try their best to answer your questions and
give you ideas for how to ultimately find the answers to your questions.

I don't know how the conjugal sponsorship program works, exactly, but have read that it is often quite difficult to do.
My advice to you is to start gathering anything and everything that you can to prove that you and your partner are in a real relationship.
Whether you can sponsor under conjugal partner, or will need to wait until you are either common-law or married, is only part of your `plan'. You will need real evidence of your relationship no matter how you have to sponsor your partner (photos, emails, text messages, phone logs,) as well as things like joint bank accounts, letters from friends and family, etc.. Marriage requires some proof, common-law more proof and conjugal partner A LOT of proof!

While you wait for people to respond to your post here, spend the time researching other posts that basically ask the same question. You can start by simply searching the words conjugal partner.

Good luck!

It sounds like it. Conjugal is mainly used for Filipino citizens who can't get divorced, which is what your case is. I've heard annulments take an incredibly long time so others have applied under conjugal while annulment is in process, and have been successful.

2. We have a child in common, do you think we have more chance getting accepted?
I would imagine yes, a child in common would add to the proof that your relationship is definitely real.

3. Should i pursue the application and try our chance?
Yes, i see no reason not to submit the application right away under conjugal.

I personally know of two couples who've had a fairly easy time of it
with the Canadian partner sponsoring.
In one case the partner was from Ireland.
In the other, the partner was from Ecuador.
I noted this esp. bec. I was interested to hear from them
both that the English test had not been required!
In one case they used no representative, the partner was already in Canada
with a work permit and a job. They filed on their own, had no troubles and are
not married.
In the other, the partner was in Canada w/o a work permit
spouse employed and sponsored him. He still doesn't speak English!
They used an attorney - all was very easy due to that I think.
These cases don't exactly match yours, but might be encouraging
although yours is of course more complicated
by the divorce situation...but my impression is that Canada makes it a bit
more comfortable to sponser spouse or domestic partners. Good luck!
