No. However for the most part lawyers know very little in common law status (except spousal sponsorship). Right now you need to demonstrating 12 months of common law status. It does not have to be immidiately before the application is sent in. You just have to prove at some point you lived with your spouse for 12 months. That's CIC rules.

Contact them with an RC65 form you can download from their website. It's a volunteer correction. They may recalculate and get you to pay more taxes (or they may owe you some) but it helps making sure everything is the same.

The CRA start date of common law is a year after you started dating, not the date you started as in the CIC declaration.

I still feel uncertainty here. My friend's lawyer said that we should have a try to submit the application however if CIC found the conflict, it would be a big problem.

Again, to qualify as common law in cic's eyes you have to prove 1 year of a relationship. In an ideal world cra and cic would match, but by not changing cra details you may be commuting tax fraud, but not immigration fraud, if that makes sense?

Just send cra a RC65 form and get that updated.

Also even if you go by Jan 2015 here, that means you started your 12 months relationship Jan 2014 (as tax date is a year later).

So you have had at least 2 years together if cic check cra. Again, having them match would definitely help, but you have at least filed as common law for 2014 and maybe 2015 taxes. You will still meet the min requirement for common law for cic (as well as other proof).

Be honest in this application and provide as much proof as you can.

Again, it's not great, however all you need to prove right now is that you have lived with your partner for 12 months. You could have been in a common law relationship with someone else in the past and broke up with them. Just be honest here.

Yes. Any post addressed to the same address. Joint bank accounts. Flights booked together etc...

However, when I continue the application, to the section where I need to upload the supporting documents, there is no option for me to upload proof of common law except "Statutory Declaration of Common Law".
