I have moved to Mexico, in order to become 'commonlaw' with my current boyfriend so I can sponsor him to come back to Canada with me. Currently, you need to live together for 12 months to be considered commonlaw. I am wondering however, he is currently separated from a previous marriage and is in the midst of going through his divorce. Do I have to wait to start the 'commonlaw countdown' once he is divorced, or can we be considered commonlaw even if he is still married to his previous wife? I just need to know when I should apply. Thanks so much

I too am in a position where I am still married and we thought we would have to wait till my divorce was finalized before applying for common law, after speaking with our immigration lawyer we learned that we could go ahead with the common law sponsorship as long as I had been seperated with my ex husband for more than one year. I am canadian and live in Canada, I am not sure if it is the same with the reverse situation but I would assume so :)

That's awesome news for you guys! We ended up finding this out as well through a series of events so I'm so excited to be able to submitting our application in 2 short months :)
Where are you in the process?

We are just submitting our application, so the very beginning, but I think we have a pretty solid package together with help from our lawyer who has been amazing !

The package will go out at the begining of next week, I am so excited to see words, "in process', I know I will have to see those words for some time but at least we are on our way !

Good luck to you guys too, are you applying outbound as well ?
