Common Law Sponsorship Question

Hi.

I am about to apply for PR under Common law sponsorship.

I just spoke with a lawyer (over the phone) who tells me she "thinks" because I never divorced my ex wife I cannot apply under common law.
Could anyone clarify this for me?

I am from the UK. I have not seen my ex for over 3 years.

Any advice would be most appreciated.

As long as your marriage has broken down and you have lived apart for at least 1 year, you shouldn't have any problems sponsoring your common-law partner...provided you HAVE been living with him/her for at least 1 year.

Yes we have been living together, bought a house and are very happy. Just want to get the PR sorted and get on with life!

I had a feeling the lawyer was wrong, but know that this forum is usually the place to get the answers.

A word to the wise... You should get your divorce sorted out and a clean-break agreement.
Otherwise your ex can come after your assets at any point in the future...
