Common-law sponsorship or Express entry skilled worker: Which is the better?

Hi all,

I am a Canadian citizen. My common-law partner is from South Korea. We have lived together for four years. My partner applied for PR a couple years ago through the PHD stream with the federal skilled worker program but was denied for not having enough of a settlement fund (partially because she added me on as a family member part way through and was expected to have a settlement amount for me even though I am a Canadian citizen). We want to apply again but this time we are debating going the sponsorship route or the express entry skilled worker route.

I am leaning toward sponsorship because it seems more likely, but my partner is leaning toward express entry. She would have a high score with Express entry so would probably be invited to apply for PR, but I feel more secure with sponsorship. Although a disadvantage of sponsorship seems to be that the wait time is longer. We are feeling the pressure to apply soon as her current work contract expires in September of this year and we may move abroad for another temporary work contract at that point. We hope to return to Canada afterward.

Considering the previous attempt at an application, that we may temporarily move abroad this year, and that she currently has a post-graduation open work permit that expires in 2.5 years, would we be better off with the express entry application or the sponsorship application?

Definitely sponsorship. With the federal programs you never know where you are in the process. At least with spousal sponsorship you can monitor other's applications via the same VO on this forum and circumstantially track your progress. With rare exception your timeline could be out of line with the norm.

100% do a common-law app under family class sponsorship. This assumes you have solid proof/evidence that shows at least 12 months of continuous cohabitation (so shared lease, financial accounts, beneficiaries, mail to same address, etc)

Make sure it's an OUTLAND application. CIC may choose to process it based on current residence (in CPC-Ottawa) or Korean citizenship (Manila). Either way, it should take approximately 1 year to complete.

During the outland processing time, your partner can continue to stay in Canada and work under their PGWP.

Also since you are a Canadian citizen, you are both free to relocate anywhere in the world while the app is processing. If this happens, you may just need to show proofs you intend to return and settle back in Canada when the PR app is approved.

If I'm hearing you right, we can use the Outland process even if we are in Canada and will remain here for the duration of the processing of the PR?

I took a look at the application for Outland and if is very much framed form the assumption that she/I are not in Canada so this is confusing!

Ya CIC could word it a little better to avoid confusion. Rest assured though it's 100% ok to do. CIC Inland guide even recommends you apply outland instead for faster processing times.

"Outland" just basically means that you don't get implied status in Canada so if you want to stay here it needs to be on some status separate from the PR app (so visitor, student or worker), and that the application may be processed in an office related to your country of citizenship.
