Hi All,

I have been living with my partner for more than 5 years. I have received my PR and claimed single. Now I want to sponsor my partner through common law. This is our condition:

1. I have a PR and sent my citizenship application 6 months ago
2. My partner is on PGWP
3. We have the house rental agreement on both of us names (for 4 years)
4. We have the our car insurance on both of us names for one year
5. We have a joint account, insurance, and bills for 2 months
6. We have letters from our landlords that they we have been living together for many years
7. We never filed taxes together (this is worrying me)

- My question is, if we apply through common law (I did not declare during my citizenship application) will affect my citizenship?
- We did not file taxes, is this going to affect the my partner PR application through sponsorship
- Should we inform CIC for changing my status to common law and then apply for PR?

When did you land and officially become a PR or Canada? At that time, had you and your partner lives together for one year or more?
 
Yes, we have been living together for the past couple of years and the address on our diving license and insurance, etc, everything is the same.

You were required to declare your common-law spouse before you became a PR. Most likely you will never be able to sponsor him.

For the span of 18 month (during this time I filed my PR), he was not living with me, cause I moved to another city, and he was finishing his study, then he joined me, does this help?

Time to talk to a lawyer. Most likely sponsorship will never be possible and your partner will need to qualify for PR independently through an economic immigration program.

You mean refugee? No he won’t choose that path. What about French stream? Does this require experience ce is Teer 1-3? Even though he has Canadian master degree, he could not find a job and working in Teer 4. Does that help for going to French stream?

No, economic immigration. Like Express Entry or PNP. Yes, the French EE stream requires skilled work experience.

If you had lived together for a continuous year you before you applied you would have still had to declare your partner.

when you become PR (the day you landed), did you cohabitate for a full 1 year? yes or no? better put a clear timeline so we can understand your story

now assuming you weren’t common-law by then, why didn’t you declare him in your citizenship application either? are you aware that you are common-law?

Yes, I received the PR in October 2021 and we lived together for one year
My mistake that I did not declare it in my citizenship,
What should I do now?
I absolutely did not know that I have to let them know.
