Hey guys, I need advice on how Common law partner works in canada. Also, how long could the couples live together before canada govt can accept them as common law partner?
Can common law partner filled for permanent resident permit?

For immigration purposes, common-law begins after one year of continuous cohabitation in a marriage-like relationship (living together). If one of the partners are a Canadian citizen or PR, they could sponsor their partner provided a whole list of other requirements is met. If neither are citizens or PRs but one is eligible under a different PR pathway, the second partner could be added as a common-law spouse to an EE application, for example, provided a whole list of applications are met.

In short: 1 year. Yes. Maybe.

- A common law couple have continuously lived together for at least one year where one of them is Canadian citizen or PR.
- A proof(s) of cohabitation is a must (e.g.
Leases or rental agreements in both your names, Utility bills in both your names like hydro, joint bank account etc, tax returns)
- They might ask you to send photos as proof of relationship.

Are these all documents necessary for proofing common law partnership?
My partner and I (Same sex) are in a 14-year relationship, We have bunch of pictures throgh these years, also have a joint bank account since 2010, but have no leases or rental agreements because we lived in our own home.

Are you sponsoring your partner? If yes the most important thing is that you had their name as your common law partner when you filed the refugee claim / PR application. The might ask you for extra documents, it is common practice.

The house dead in both names is an accepted proof of shared life.

Dose your country acknowledge same sex relationships? If not you can sponsor your partner as conjugal partner.

Thanks for reply.
Yeah , actually I added him in my initial PR application as my common law dependent and still waiting for AOR.
We both secretly lived together in an Islamic country that it's totally illegal to have a same sex relation.
Did i do wrong to add him as common law instead of conjugal partner?
I do'nt understand the difference between common law partner and conjugal partner.

If you couldn’t live together but maintained a mutually, exclusive dependent relationship over the years (physical, emotional, financial support, etc) But were unable to cohabitation, that’s conjugal. There would be barriers (local laws, customs, divorce) that kept you from living together.
Since you managed to live together for over a year, that’s common law. And you did the right thing including him/her as such.

Hi All, I have a question. I want to sponsor my boyfriend who is living with me in Canada since 2022. He is currently studying and I am a PR holder. Please suggest what is the process to sponsor him. He got married but living separately for 6 years, not divorced on paper. No family or court issues. his wife has been estranged for 6 years. Is he eligible to be sponsored under common law in BC, Canada. Your guidance is highly appreciated.

Are either of your asylum seeker or protected people? Have you lived together for a continuous year and do your have proof that your have lived together for a continuous year? Where does his wife live and why has he not applied to divorce?
