Common Law partner calling it QUIT. Need HELP guys!

Good day guys. I need help on what to do next. Me and my girlfriend has been together for 6 years and 2 months. I got my permanent resident last January 2017. We've been living together going 5 years now in Canada. We filed under common-law partner. Sharing little bit of my life in here Canada, i first came here as visitor visa to visit her. 3 years on the relationship in Canada, i found out that she was cheating behind my back. So our relationship had hit the rock bottom that time. We still living under the roof during that time, so we just didnt talk at all. So month later, she asked sorry and because i love her, i gave her a chance because we know each other very well and im closed with her family as well. And we started to file for this common law a year later

So long story short, we always had fights as the normal couple do and what I dont like about her every time we fight, she always threaten me to send me back home. I know this is not healthy because in relationship, threatening partner isn't good at all. So yeah skip the time of processing, I finally got my PR last January 2017 under common law. She told me everytime that i am under conditional PR. By the time she told me that, i knew she's gonna "use" that "term" to scare me again in case we have fight again. She will just gonna continue threaten me. But when i reviewed my COPR doc, I didn't see anything about Category 51 on my doc. It says "none". So i dont know either she's lying or what.

So after all the struggle we recently both sat down and we called it quit. And as I expected, she told me she's gonna pull out my papers and even threaten me to file to CIC as a fraud when it's actually not. So I need help guys on what to do next. I have good career in here already, soon to be promoted as "full-time" job and it's hard to give up those and going back home and start from zero again. Is my case is too complicated that I should hire a lawyer to help me out because I want to stay in Canada badly and she threatens me to pull my docs and file it as fraud and I will be deported. Because you were in a common law relationship for more than 2 years before you applied you are not under condition 51. She can report whatever she wants but cic will not investigate as they will simply see this as revenge etc.

Be happy, continue your life here as normal. No need to feel threatened by your ex spouse.

Thanks for the reply. So does it mean CIC won't ask me to leave the country and I could still possess my permanent resident status here in Canada without being revoked?

Nope, don't worry about it. No condition 51 on COPR you are fine. It shows it on the PR card too.

My husband and I were common-law for almost 8 years before getting married, but we still got the condition 51. So I know what it looks like ;D

You were together for a long time and already proved it. There's no way it's fraud, she will just get herself in trouble for lying. They probably have crazy angry people "reporting" things all the time.

If you have proof of her cheating, like texts or emails etc. keep that available.

I had prove before but they all gone now since it happened like 2 years ago since we wanted to move on. Plus I wanted to separate peacefully no hard feelings whatsoever as long as she won't do such things about fraud and stuff. But her parents aware about our problem because they are here as well in Canada.

She can certainly contact CIC - but they're going to ignore her and won't investigate you. You've been together for too long. This isn't fraud - it's just a relationship gone wrong. Your PR status is safe. She has no power over you.

Okay so she told me the reason she wants me to go home because my name still attached on the permanent resident under common law. She is the sponsor and she wanted me "out completely" from her record because she said in the future, if she's planning to sponsor somebody, she said it will be rejected because on paper, she still "sponsoring" me even we break up. Does this make sense to you guys? I am sorry I am not that knowledgeable about this but Im still doing research and your input will certainly help.

She can't sponsor someone new for three years from the time you landed. Once those three years have passed, she can sponsor someone new.

Even if you "go home" - this will still be the case. You would have to officially renounce your PR in order for this three year obligation to disappear.

You should inform her that she is required by law to support you financially for 3 years. Just tell her if she decides to cause trouble, you might just decide you need social assistance. Guess who'd have to pay it all back?

I'm just saying, if she is truly threatening you, maybe you can give her a reality check :)

Exactly. Her threads are empty. If you go on welfare, she has to pay this money back to the government for three years after the date you landed. She should be nice to you if she wants to avoid problems.

I don't know if that applies on my situation. You see, I was here already when we processed the common law thing and I just got my PR last January this year. So this talking about three years support, do they apply the time I got my PR?

It's based on the date you landed as a PR. So if that was Jan 2017, she is responsible to pay back any money you take in social services/welfare, until Jan 2020.

She also can't sponsor any new spouse until after Jan 2020.

And to re-enforce what's already been said, she can do nothing to your PR status. Since you have no conditions, you will have PR forever (just make sure to keep in compliance with residency obligation) or until you get citizenship.
