Bit of a tricky one.
I am actually in Canada now on a working holiday visa, and living with my partner.
I am Australian and my partner is Canadian.
She was in Australia for 2 years where we lived together etc, she was still on the lease beyond this two year period however she did not have a visa in Australia for the last 6 months- she was completing an internship in India. I traveled with her to India, and visited her about 4 months into the internship as well.
So my question is, would we still be eligible to apply for the common law spousal visa? We were not cohabiting for the period of 6 months but that was due to her being on an internship, and me having to stay at home to wrap up some things before I relocated to Canada. Just dont want to waste my time/money if I should be waiting until we have lived together in Canada for 12 months.
Any help would be much appreciated
