Hi, I am on a closed work permit, and reached Canada in Mar 2020. But, I was just laid off. Till when can I legally stay back? Work permit is valid till fall 2021. Company wants me to fly back to india immediately, but I want to delay my departure by a 1-2 months given current covid situation in India. Could someone help? Thanks

You can stay in Canada as long as your work permit is valid.

Thanks. A quick follow up. The company has already sent a note to the local HR team that work permit is not valid anymore since I've been laid off. But, the actual validity is till fall 2021. Can I still stay back? Maybe speak to the company to not cancel the work permit?

Your question was already answered. You can remain in Canada as long as your work permit is valid. Your company cannot cancel your work permit.
 
Hi @scylla a follow up question, I am in India and have a work permit valid till 2026 the company changed the plans and no longer interested in sending to canada. My spouse is still in canada and employed. I have W1 TRV stamped on passport. Can I travel to canada on that TRV without having the payroll or recent offer letter and later apply for sowp from inside canada. Do I need to inform the border agent at the airport that the organization has not confirmed my transition however I came to accompany my spouse. Thanks in advance.

What kind of work permit does your spouse hold.
 
yes applied after closed work permit approval TRV is W1 based on WP. Married since 6 years and stayed together since then.

How are you living together if you spouse is working in Canada? When does their WP from ICT expire?
