Hello everybody, I am currently with my husband in Montreal on TRV. I arrived in late July 2023. We are applying for PR but are not sure which class is best for our case.

From what I understand:
- Under the Spouse or Common-Law Partner in Canada Class (the option we want to go for) required proof of documents such as joint ownership of residential property or rental agreement, etc. which my name is not really on anything at the moment.

- If we choose the option that I am currently living in Canada and applying under Family Class, the interview will probably outside Canada (most probably in my country) and I am not planning to travel outside Canada. Ideally it would be good if I keep living in Canada until I have the PR and I would like to apply for the Work Permit after.

In your experience or point of view, what would be the best option for our case?

Thank you very much in advance.

Spouse or common law partner is simply a type of family class application. So, you are looking at a family class application in any event. And, unless you intend to return to your country (which you say you do not wish to do), it will be an inland spousal application.

I am assuming you were married and that was declared when you received your TRV. In that case (and even without the TRV), it's unlikely that an interview will be required. Moreover, if it's an inland application, you won't be told to return to your home country, should an interview be required for some reason.

As for documents evidencing joint ownership, etc., I do not see that as of much importance. You were married already when you arrived recently on a TRV. All the IRCC wants to know is if the relationship is genuine. Documents of the sort you mention should not be required to demonstrate that.

Your question has nothing to do with OP's nor the title of this chat..
Post your question in related discussion. (e.g. which month you applied so to compare with others that's going through similar time to process)
