All,

Does anyone have an idea how the count the days for citizenship? Do they look back 1095 days from the DATE IN THE APPLICATION? or do they look at when the application is logged in the system ie. we began processing your application... ?

My situation is as follows:

1. I applied exactly after my 1095 days in Mar '13. I had exactly 365 days out of country when I applied(since I had to return to my home country to finish my work contract after I landed + vacation days in the US/home country).
2. My application got sent back to me in April '13, because of my passport picture, and I resent new passport pictures.

My e-cas is as follows:

"We received your application for Canadian citizenship (grant of citizenship) on May 6, 2013.

We sent you a letter acknowledging receipt of your application(s), and a study book called Discover Canada on May 6, 2013. Please consider delays in mail delivery before contacting us.

We started processing your application on July 19, 2013."




Now that I look back, I wish I had waited a few days before sending it, but I was eager at the time(and didn't know about this forum). As far as I know, I was very honest with the days that I was out of the country but now look back with worry in case I may have miscalculated a day here or there.

Question again is what date will they look at when they review my application... my original signed date or the date they logged into the system?

Any feedback would be appreciated.

PS: I own property in Canada as well as have Canadian born kids.

If you used the residency calculator on their website and it said you have enough days, you should be ok.

3. (1) An application made under subsection 5(1) of the Act shall be

(a) made in prescribed form; and
(b) filed, together with the materials described in subsection (4), with the Registrar.
(2) and (3) [Repealed, SOR/2009-108, s. 4]
(4) For the purposes of subsection (1), the materials required by this section are
(a) a birth certificate or other evidence that establishes the date and place of birth of the applicant;
(b) any document that has been or may be created by the Canadian immigration authorities, or other evidence, that establishes the date on which the applicant was lawfully admitted to Canada for permanent residence;
(c) two photographs of the applicant of the size and type shown on a form prescribed under section 28 of the Act;
(d) evidence that establishes that the applicant has, within the four years immediately preceding the date of his or her application, accumulated at least three years of residence in Canada; and......

This means apply on day 1096 or thereafter as day 1095 must be included in the count and as such must have been passed (read after midnight!). Its usually wise to apply with a say 10 day buffer to reduce the risk of a miscount but if your math is right then apply once you get to the required days. When you re-submitted the application did you fill out the residence calculator again and sign a new date?
 
Kenyadian, as Leon has said if the residence calculator said you are eligible, it means you are eligible. Here are small caveats I could think of:
- you need to make sure that all of your entries into the country are recorded at the proper time. For example, you may believe that you came back on one day at, say 23:59; however, the system records your entry at midnight the following day;
- you were away from the country on February 29, 2012. Some people on this forum claim that residence calculator treats absence on this day differently than the internal CIC computer system. I am not sure about that, but it may be true.
To avoid any issues, you could have given yourself a couple-day buffer, but there is no reason to worry at this point. I would recommend getting a CBSA travel history report. It is free and takes a month to get. At least, you will get a peace of mind knowing that your records match theirs. If everything else matches, there is nothing to worry about: the CIC own system told you that you are OK to apply. I don't see (and am aware of no such cases) where CIC would punish over-eager applicants, who apply on the very first day they are eligible.

Andriy - Thank you for your input.

Regrettably, I didn't resubmit with a new residence calculator, merely retook my pictures and sent it on it's way. I guess there isn't much I can do except get the CBSA forms (as Andriy suggested) and make sure I have all the right days in place.

I'll keep the forum updated should I hear back from the CIC.
