CIC RETURNED SPOUSE APPLICATION - URGENT HELP NEEDED GUYS!

Hello All,

CIC Mississauga returned our spouse sponsorship application submitted on May 9 2014 (we have been in contact with them to locate our application for over two weeks since it was passed the step 1 processing time - nothing was shown on the CIC system). Finally we have it back. however it was returned unprocessed.

They sent a letter along with stating that we must provide current and completed spouse/common law questionnaire (IMM5285 08/2013 or later)! On CIC website this form is Inland application package. we are applying outland and SUBMITTED a similar form IMM5490 since it was under sponsorship outside of canada.
Are we missing something? what should we do here?

Can you please shed some light and help?

Hey there! My friend got similar situation! She applied outland, staying in canada, but she also submitted open work permit, that she shouldnt. Anyways, she attached all outlnad documents. Her application was lost for many months (since March 26th,when CIC received it untill mid July..). Later CIC found her application and they said one document is missing, i believe its exactly the same one as yours... So their application has been returned. After my friend called CIC again and explained that they dont need this document.. CIC officer said that they are right and it was a mistake. Please call CIC ASAP and tell them u got outland application and IMM5490 is the form u found in guide and IMM5285 is one u dont need!!

my advice would be to go back online and print the checklists for your country's specific instructions. go through all the document numbers and make sure you have thm complete. at this point, if cic didn't give you a file number or started processing the application, you are starting from scratch, so it doesn't really matter what the letter says. it is possible they made a mistake and an assumption the application was inland.

there's a chance you may need to redo the application forms, since they could have been updated. again, i would recommend printing them all out so you know you have the right ones. there is no rule that says you have to fill out the application on line. i hand wrote my answers on the form, and supplied typed responses for questions that needed extra space.

She didnt make mistake, CIC made mistake! They already admitted it when my friend was going through TWIN situation!
I think you should talk with them and explain, later maybe they will speed up your process because you have stamp from May.. Remember to stay with your outland application,dont change it to inland.

Thank you Meiko and rhcohen for the insights. Shall I call CIC call center or email CPC Mississauga diectly. I have been in contact with them when my application was lost.

During one correspondence email with Mississauga when they there trying to locate my lost application, they specifically asked whether I am applying within Canada or overseas (sponsored person is outside of canada), I replied that we applied for overseas / outside of Canada.
(wife's visa office is Ottawa- being US citizen).

Yes they are stamps on forms that state received on May 9th. I am not sure how they will treat the new forms - aka whether we will lose queue and start queuing all over again

all inland applications have been transferred to mississauga. Mississauga is now processing inland applications as well as sponsor eligiblity for outland.

Just call them.. talk and explain.. tell them it happened before to other people. They must have wrong information there, they should fix it coz many applicants lose precious time.. Then apply again ASAP. I hope they will put you in the queue, but cant be sure of anything. Good luck!

Does anybody have the CPC Mississauga direct phone number other than the CIC call center one? Appreciate it guys.

there is no direct number. you must use the call center number to talk to cic. the call must be made within canada.

I called CIC and they believe the agent might have made a mistake. They advised to return the application to CPCM with a letter explaining that I do not have to fill IMM 5285 as I am applyin outland. They said I should update the outdated if any. There are actually two forms out as of june 2014 (IMM 1344 and IMM 0008. I updated them, however no change from the prior form except for a very minor tick in one and a birth date of a former spouse if any. The thing is that these are the two forms with barcodes and the only two ones that have the may 9th 2014 received stamp on them plus some handwritten code. I hope the new forms wont delay processing my application further

Hello!

We called CIC today to check on our application and were told the same thing! We applied Outland as well and were told we were missing form IMM 5285. It wasn't until after we got off the phone that we realized that this was their mistake, not ours. We tried calling back but the office is closed so we won't be able to reach them by phone until Tuesday. Of course, they just mailed our application back to us yesterday, though, so I suppose we have to wait until we receive it to send it back?

This is my nightmare. I hate that we're being punished by having to start over due to CIC's mistake.

Wow,this is just crazy.. hard to believe..3rd time it happened in very short time. I start to think they maybe got some kind of new checklists with mistake..
Both of u cant do much, just need to call and explain, then send again and attach letter of explanation.. Maybe pack documents in envelope and write with huge letters Sponsorship Outside Canada
