hi guys

im getting ready to submit my documents (family sponsorship Australian Outland, application) and then travel to Canada to visit my wife.

My 13yr old from previous marriage live with her mum.

she may be interested in being in my application but would not want to live in Canada at this point in time. but come for the occasional visit.

would this be ok or is there a requirement that she would have to spend a minimum amount of time in Canada if approved?

I would imagine children PRs are required to fulfill residency requirements just like all PR's, so if the child does not intend to live in canada to fulfill that requirement, from what I understand, they should NOT be put as an "accompanying" dependent, they should be on the application as a "non-accompanying dependent". This tells CIC about the child and allows them to do the necessary checks for the child to be eligible for sponsorship in the future, when they are ready to live in canada (prior to the cutoff age for dependents).

If the child is put on the application now as an applicant who is seeking PR immediately upon approval (as the spousal/dependent pr applications assume), they still need to come to canada to "land" as a PR to officially be a PR. The parent can't land for them, the child will have to be physically present. While it's possible for them to return to their home country after they "land", it's important to remember the PR status may not be renewed in the future, if the residency requirement can't be proven. "Occasional visits" will not fulfill PR residency requirements.

I am sure others with experience with dependents can confirm this information...
 
Also keep in mind if going to apply for PR later on the child becomes a non dependant from 19 years old

I suggest you include her as accompanying and have her land as a PR with you, even if she is returning to Australia. If you apply for Canadian citizenship before her 18th birthday, she can be included in your app and become a Canadian citizen as well.

What about RO requirements? Do children not have to meet them to remain PR or apply for citizenship along with their parents?

To remain a PR, yes (though there are exceptions granted in some situations, such as a PR removed from Canada as a minor by the parents).

To apply for citizenship through the parent, nope.
