Child share custody with my ex, would it affect?

Hi, i am a mother of a 7 years old child whose custody is shared with his father who lives in Japan (me and my son we actually live in Peru, South America). I recently got married for second time and me and my husband we already put all the papers together so he can sponsor us to meet him in Canada, we were wondering if the share custody i got with my son´s father will affect the procedure. Thanks!

Yes. You will have to have a notarized or authenticated document from the father giving you permission to move to Canada with your child. If you do not include such with your initial application, they will request it anyway.

Thanks for the soon reply :) we already did, my son´s father sent from Japan a document signed for the peruvian consul there in Japan giving permission to my son to move to Canada :)) Our concern is about the share custody since the lawyer we are giving our case to wants to submit my divorce sentence certificate where specify that i am sharing custody of my son with my ex and he (my son´s father) is entitly to see his son in the hours scheduled, lawyer says the share custody might be a problem..is that correct?

Well, I'm not an immigration lawyer, so if your immigration lawyer is concerned about it, what does she or he suggest that you do in addition? Still, I've never heard of anyone having an issue when they had agreement from the other parent.

Note that the father would be able to enforce his parental rights in Canada if he so chose.
