Hi Guys

Hope you are doing well.Need your guidance on an important issue which just came across me and my wife.

We are PR card holders and PR was issued on May 20, 2016 when we landed in Canada. We stayed there for a week and came back to our country. We now must have to be there by May 25, 2019 so that we are in Canada for 730 days when our PR card geta renewed in 2021.

My wife is expecting a child in December 2018 and I don’t want to settle permanently in Canada before May 2019. So what should I do, will I be able to easily add my new child when we go to Canada in May 2019 or I need temporary Canadian visa/passport for new born and more importantly does CIC gives it easily.

If above is difficult and risky (as I can’t go back once I arrive in May,2019 due to 730 days threshold breach risk) should I come now with wife and stay for 2-3 months, have child in Canada go back to my county and then come back and settle permanently in June-July 2019 or just have my child in my own country and then come with my child in 2019 May and will CIC allow my child to settle with us permanently from May 2019 onwards.

Please assist. Looking forward to your usual cooperation.

There is nothing to add the child to. No, IRCC does not easily give TRVs in this situation.

If you can afford to pay for all medical costs related to the birth, the child and any potential complications, sure, you can do that.

Many thanks for your swift response. So are you suggesting I should come now to Canada. Furthermore I was of the opinion that medical is free in Canada, so isn’t child birth in Canada free.

Also please confirm my understanding from your response, it will be difficult to permanently bring my new born baby as IRCC may not allow temporary passport/visa.

As a PR in Canada, if your baby is born outside Canada.....you can't sponsor your newborn while you reside outside Canada.....only PR living in Canada are eligible to sponsor their spouse or dependent child for PR in Canada.......refer.....who can sponsor.......you must take seriously your PR obligations to maintain your PR status.

You must be resident in Canada to submit the dependant child sponsorship application and required to live in Canada while the dependent child application is being processed.

if your baby is born outside Canada....you could also apply for TRV for the baby, and if TRV is approved...baby could accompany the mother to Canada.....and then apply to sponsor baby for PR while living inside Canada.

If your wife were to deliver December 2018 and you are living outside Canada....you will have to wait until you move back to live in Canada until you could sponsor your newborn to become PR in Canada.

If you could afford your wife coming to deliver in Canada....as a PR card holder she would have some medical benefits......your child will become a Canadian citizen by birth.....and could leave outside Canada with the parents until your family permanently move back to Canada.

In order for your medical cost to be covered you must remain in Canada for 6 months. Some provinces also have a waiting period of up to 3 months until you get medical coverage. These are unfortunately the issues that come up when wanting to stay out of Canada for the first 3 years of PR. You will also have to realize that by arriving on May 29th you can't travel easily if you have a family emergency, just want to visit family or need to travel for work out of Canada.

Nobody can tell you whether your child will be granted a TRV or a TRP if TRV isn't granted. It seems 50/50 these days. TRV would be 6 months and you would have to renew it if you still hadn't received PR. You should purchase emergency health coverage for your child and you will have t pay for regular visits in many provinces. You should get a response pretty rapidly 2weeks- 1 month but that is dependent on how busy and the speed of the local Canadian visa processing centre. It will likely take 6-8 months to get your child's PR but you must be in Canada to initiate the PR process and be compliant with the RO. Would recommend your wife also be compliant with her RO. All anyone can give is estimates for times although newborns are usually processed faster than older children.

It takes 3 months to get healthcare in Ontario. You can sign up earlier but the start date will be in 3 months.

If you choose to have you hold in Ontario there are other rules. If you don't follow then you could be asked to pay back all the money that has been spent on the healthcare of your wife and baby.

Who qualifies
To qualify for OHIP, you must meet all of the minimum qualifications listed below plus at least one of the additional requirements.

To meet the minimum qualifications you must:

  • be physically in Ontario for 153 days in any 12‑month period
  • be physically in Ontario for at least 153 days of the first 183 days immediately after you began living in the province
  • make Ontario your primary home.
If you want to give birth in Ontario you would have to arrive at least 4 months before delivery date and hope your wife doesn't give birth before 36 weeks. You would have to pay cash for all tests and appointments for the 3 months. Very common to give birth from 36 weeks on. Then you would have to wait a few more months so you have stayed for 6 months and then you would have to get a Canadian passport for your child if you want to return to Pakistan.

I understand that I have to be in Canada to initiate the TRV application. What if I have baby in my own country then come to Canada for around 2 weeks and initiate the TRV process. Do I necessarily have to remain in Canada till I get TRV or TRP.

If I get success in TRV/TRP I can come with my child in May when we have to
permanently settle to have 730 days presence.

You don’t need to be in Canada to apply for the TRV/TRP. You can apply from your home country. You do need to be in and remain in Canada to sponsor them for their PR.

Further to your suggestions, please also suggest should i directly apply for TRP instead of TRV since everyone is of the opinion that TRV in all probabilities will not be approved.
