Child birth in USA after PR Visa issued

Hello everyone,

I am naturalized Canadian citizen. My wife, who is foreign national, and I are currently living in USA, near Canadian border.

My wife just got her PR Visa (spousal sponsorship) but has not landed in Canada yet. My wife is pregnant and our baby is due in 1 week. We have advised VO of pregnancy while applying and from officer's notes (obtained under ATIP) it is clear that they are aware of pregnancy.

We would like to have baby in USA and then have my wife land in Canada (i.e. cross border by car at port of entry). Our baby will have USA birth certificate which is sufficient to cross the border from USA into Canada. Also, our child will have a right to Canadian citizenship and we will be applying for this once we are in Canada.

My question: Do I have to notify our embassy after baby is born?

The forms we received from embassy (the forms were included when passport was returned with visa) state that we have to notify VO. However, I am not sure this applies to us because our child is going to be Canadian at birth. Therefore, visa office does not need to issue any visa to our child.

If anyone has been through this, please advise.

Yes, you still need to notify the VO of the child's birth but as s/he will be a Canadian citizen, it won't affect the app or your spouse's documents.

I strongly suggest that you apply for the child's Certificate of Citizenship ASAP after the birth and apply concurrently for a limited validity Canadian passport. Otherwise, you will have no proof of the child's citizenship when you come to Canada and may face issues accessing things like provincial health coverage.

Your child - or you for that matter - will only have access to health coverage 3 months after moving to Canada. You should definitely apply for his citizenship certificate ASAP, they take a while. Passport is then much faster. We did not do the limited validity passport so that may be a faster option to getting a passport..

Thanks for response. I am aware about the health insurance situation and have already looked into it. My main reason for post is to get thoughts about immigration aspect (i.e. how birth of a child affects my wife's PR Visa which as already been affixed to her passport).

I see that some people notify VO and then their PR Visa get cancelled. Afterwards, embassy adds child as accompanying member and issues new PR Visa. However, I am not sure if this applies to us because our child will be Canadian (i.e. no visa from embassy is required). Essentially this is what I need to clarify.

I can only share that in our case my child was not declared as accompanying me/dependent since he was Canadian through the mom. We did not have the certificate yet at the time but that was never an issue. On the GCMS it is noted that my son is not part of the process since he's child of a Canadian. So, I would not expect it to affect at all her PR Visa since he would not have been part of the application anyway. But this is only my experience, take it for what it is...

As I already stated, the child will be Canadian, so there is no effect on your spouse's app. The child would only need to be added and your wife's documents returned to IRCC if the child was NOT Canadian. There is no other answer to this question.

Now that I have child on its way, does that mean that VO has to go back to our application and re-assess for financial eligibility. My income is quite high so that will not be an issue. More importantly I am worried about the time it takes for them to do this re-assessment. Thanks.

There is no financial benchmark to sponsor a spouse.
