Change status to Visitor - Help

Hello friend,

I came here as a student for one year and got married to a permanent resident.I have applied for outland sponsorship on June 15,2015 with in canada. My wife got Sponsorship approval mail as well.Currently I am staying on one year work permit . If everything goes well I guess I will get my PR before June 2015. But the problem is my work permit is expiring on Dec 11th, 2015. I searched for a job with LMIA and didn't get any. I guess my only option is to change my stay as a visitor. Do you guys can suggest any other option for me to keep working untill I get my papers?

If not please tell me how the visitor visa works. If I apply to extend my stay as visitor will it be approved 100%? or is there any chance to get that rejected? Do I have to mention in the time limit for extension? Do I have to mention that I already applied for outand sponsorship?


Please help me guys. I am confused. I always get better advice here that some of the lawyers in canada. Thanks in advance.

What country are you from? Visitor status varies with countries. Your best bet is to go to the Visit section on the CIC website and take the "determine your eligibility" quiz

Thanks for the kind reply dear. I am from India. I checked the eigibility, it says I am eligible to extend your stay in Canada as a visitor / tourist.

Then you should apply at least 30 days before your work permit expires. I think it's only a couple forms and a fee of $100 or so.

You can actually submit the change of conditions request within 30 days of your WP expiring...even one day before. CIC prefers to have it 30 days before the expiry of the current status, but it's not a requirement. This will give you implied status (as a visitor, NOT as a worker) while your request is being processed.

The request can be denied, but with proof of an approved sponsor, the chances may be small.


Unfortunately, without the LMIA, you will not be allowed to work after your WP expires.

So KelseyTVS ..DO I have an option other than visitor visa to keep working?

Getting an LMIA is your only option if you want to work before you have PR.

There is always some chance that your application to change your status to visitor will be refused. If it is approved, you'll likely get six months.

Hello scylla,

So If I get a 6 month visitor visa and what happens if I didnt get my PR in that 6 months. Do I have to apply for 6 months again? Or Can I straightaway apply for one year visitor visa?
