Hi my parents are illegal in US for over 5 years and I want to sponsor them to come live with me in Canada. I am a Canadian citizen

Can I do that?

Do they have to go back to country of origin first?

Also do they have to list the US as their place of residence and show their status there?

How will that affect me sponsoring them?

your advice I look forward to thanks

Yes - you can sponsor them provided you meet the sponsorship requirements.

Since they have no status in the US, their application will be processed through their home country visa office. If an interview is required, it will be held in their home country and they will have to attend in person. Their passports will also have to be sent to their home visa office once CIC is ready to issue their PR visa.

Yes - they must list the US as their current place of residence and must indicate they have no status in the US. Doing otherwise is misrepresentation which will result in a refusal of their application and a five year ban from entering Canada. They will also have to obtain FBI certificates when the time comes to prove they have no criminal record in the US (overstaying isn't a criminal offence).

Note that as soon as they leave the US, they will be automatically banned from re-entering the US for at least 10 years (possibly longer depending on their US immigration history).

Just to add... I assume you know that CIC is only accepting 5,000 applications this year and will start accepting applications as of today. If you qualify to sponsor your parents, you need to get the application completed and submitted ASAP. Last year the cap was reached around three weeks after CIC started accepting applications. It may go faster this year.

Make sure you meet the income requirements before you apply. This is a mandatory sponsorship requirement.

Thank you!

Also how will them being illegal in the US affect their consideration here in Canada?

I really hope that it doesn't.

I plan on sending application to visa office responsible for country of origin.

Does that make a difference?

It probably will not affect their consideration.
You send the application to the address given in the application instructions, not to their country's visa office.
You cannot select where it will eventually be processed any longer. CIC will decide.

As zardoz said, being illegal won't affect their application provided they are 100% honest about their history.

You cannot send the application to the visa office responsible for their country of origin. If you do this, the application will be returned. The application package is sent to Mississauga. Make sure you read the instructions in detail to ensure you don't make any errors when applying.

ok thanks :D

Ok so from what you are saying I need to state that they are in the US for the last 10 years.

Thanks I appreciate your help.

Fingers crossed... sending application out today.

You need to be 100% honest about their history. So if they have lived in the US for 10 years - then yes, that's what you need to say.
