Canada visitor visa help after getting US B1/B2 10 years visa.

Hi, I am from India and working in Thailand on a teaching position. I just got a US B1/B2 10-year visa. I have been to Malaysia and Singapore. I need help regarding Canada visa. I need some information.
1. my partner is from Philippine and she is also a teacher in Thailand . we together got US B1/B2 visa and she was the main applicant in that.
2. Philippines people can get 5 years ETA but as she is the main applicant and I am an Indian passport holder so we need to apply visitor visa.
3. how to fill common law partner form IMM5409E? only our rental house address is same. we dont have kind of joint bank account neither any kind of joint aggreement of any kind. Is it ok if we blank the form and upload as it is.

You have to apply by your own, describe your circumstances, show your ties, social, financials etc and apply for a visit visa on IRCC portal.

i will add my 2cents here, Go to USA and come back and apply Canada after your US trip.

First determine if you relationship is indeed a "common law" one. Typically it means living together 12 months minimum. There are exception to this rule and that include countries where living together is not allowed unless one is married.

Now comes proving the common law:

There are a number of documents that can be used to prove common law relationship:
  • bills for shared utility accounts, such as:
    • gas
    • electricity
    • telephone
    • joint utility accounts
  • important documents for both of you showing the same address, such as:
    • driver’s licenses
    • insurance policies
  • identification documents
You can also include other evidence of co-habitation. I am not sure what will you have? Do you have some government issued document that list you two living together in the same address? Some legal documents? Some document issued by major ulities? Some document of a proof of some major purchase? Some loan together? Some investment together?

Embassy can call you for interview if your case is involved. They can interview you separately and then compare notes if they really want to be sure.

US visas are much easier to get than Canadian visas because US deports people much more easily. If you only have proof of being together on a lease as proof you are common law that is unlikely to be enough. She isn’t guaranteed the ETA. Given she has never traveled to the US and is living in a 3rd country she doesn’t have very strong ties to her home country and may not have good international travel history. Why do you want to travel to Canada? How long do you want to stay? Will it be a school holiday and will you have a job and home to return to in Thailand? Also will you both still have visas to continue living in Thailand?

US visas are much easier to get than Canadian visas because US deports people much more easily. If you only have proof of being together on a lease as proof you are common law that is unlikely to be enough. She isn’t guaranteed the ETA. Given she has never traveled to the US and is living in a 3rd country she doesn’t have very strong ties to her home country and may not have good international travel history. Why do you want to travel to Canada? How long do you want to stay? Will it be a school holiday and will you have a job and home to return to in Thailand? Also will you both still have visas to continue living in Thailand?

we both have work permits in Thailand until October 2024. The only evidence we have are photographs (India, Thailand, Malaysia, Singapore) and the tickets. And idont know is it ok if i attach the photographs with imm5409 form

do the accept photographs? like my partner she visited India and we were together. and then we went to malaysia and singapore together

travel history is a plus point, family pics are good, but should not be focused mainly.

Any evidence that is not forged will be better than none.

To be honest, in visitor visa, you are not getting visa because of your relationship. You are getting it on your own merit. So you are fine.

Generally, no. Photographs do not prove a common law relationship. All they do is show you are in a relationship / dating. To prove common law, you need evidence such as joint leases, joint bank accounts, employment records showing the same address, joint utilities, etc. You need evidence that goes back at least one year to prove you meet the common law requirement of 1 year of continuous cohabitation.

Cohabitation is the key.

But OP, you already have that due to your separate documents showing both living at the same address, don't you? Like you bank statement and her bank statement show the same address. Or your address on electric bill and her driving license showing same address.

Photo can be on top of it but not in replacement of it.

Think there is a very good chance that you will need to be considered for a TRV independently than your partner since you don’t seem to have submitted enough proof that you are common law. Do you have confirmed jobs until October? Proof that you have a home and job to return to after your visit to Canada will be important.

So, what is found is that Canada is a nice country but its Immigration is totally garbage.
The volume of applicants is very high and people also overwhelm the system with repeated phone calls and emails. It is hard and expensive to deport someone from Canada so Canada is more cautious than the US. US is incredibly strict when it comes to enforcing their policies, lock up people in immigration detention very easily, don’t provide legal aid for things like asylum claims, etc. If your case was straightforward you would have likely had faster processing but your case will likely need review by a person. All you can do is apply and wait to see what happens.
