Hi All

I am in USA on H1b Visa as programmer analyst for last 5 yrs ,i was planned for Alberta immigration... i filled all those forms and i heard the bad news that they change the pattern.Now is there any way that i can apply for canada immigration?Please suggest me

you should read at CIC website directly..!!
you may apply for Family stream , ASylum, Refugee, etc..

If you can get a job offer (AEO) you can apply for PNP immigration in some provinces. You can also apply as an FSW if you have an AEO. You can also look into QSW. Start here: http://www.cic.gc.ca/english/immigrate/index.asp

And to the previous poster, don't even think about applying for asylum or refugee coming from the US. Canada has a safe 3rd country agreement with the US so if you try that, they will just tell you you should have applied for asylum in the US and send you back there. Even if you don't come from the US, you can forget asylum or refugee unless you have good grounds for it. It may buy you a year or two in Canada while you appeal your case but if you are found not to have a claim, you will be deported.

Thanks Leon for your information ... My status is H1b Visa in USA i referred to your link,in that my occupation is not shown in the list.Actually i was in canada for 2 yrs i need to know whether that will help me in filing the PR.Please let me know

since you are already a System Analyst V with 5 years experience, I personally feel get PMP certification from PMI (Project Management) and if your role had any kind of management then request your employer / client to give you a letter saying you are designated as a manager. Even as per new NOC list manager level positions are acceptable. All the best.

By the way I am in QA and did my CTM certification from ISQTB and doing the same as I mentioned to you.

Thanks for quick response ,Actually in my I797 its stated as Programmer Analyst,if i do PMP certification then i am eligible for alberta or canada immigration ? But i don't have experience in PMP ,Is that Ok.please clarify.

What list are you talking about? I did not give you a link to a list. If you want to immigrate, you need to look at the different immigration classes and find one that you qualify for.

Your job description in H1 application has to say that you have managerial role to be eligible under 0213 code.

I think divagirl is correct to an extent that job description in H1B petition / I 797 should match that of a 'manager' position. But, we do have AC21 portability where Job titles can change depending on your current role or while you are still a system analyst / programmer you can still manage people which is quite common. As long as the employer / client can support the description then you are fine. AlNP checklist says 'experience letter from employer stating responsibilities / proof from USCIS'

I am very positive that it is not incorrect to have manager skill set while your title is Programmer. In my case I am a QA Analyst by title but actually lead / manage 8 people.

Regarding PMP certification, google for it. There are lot of resources.

If you work as a Project Manager with a I-797 that says Programmer/Analyst wouldnt that violate Labor that was filed for your H1b?
