Hello, guys

if the principal applicant in Canada with temporary status, and apply for PR under spouse sponsorship from inside Canada, if the application get refused, can the sponsor appeal to IAD? If not, is there any other way to continue?

If the application is overseas, can the Sponsor appeal?

Thanks

Applicants who applied inland will have no right to appeal.

Only applicants who applied outland will have a right to appeal a negative decision.

You can appeal via a request for judicial review, but this is mainly for appealing based on a factual error in law made by the visa officer. It is not used if you simply don't like the decision (i.e. the officer felt relationship was not genuine).

If you want full rights of appeal to argue any negative finding of your relationship, you need to process the PR app using OUTSIDE CANADA method.
