Can my sponsored wife travel back to Canada with our new son?

A bit of a strange question, but I have had no luck on the rest of the interwebs.

My wife returned to her home country to give birth to our second son. I'm Canadian and she has her first letter from CIC and we have applied for PR out of Canada. She will be returing to Canada shortly.

The question is, can my new son come to Canada without showing a ticket out of the country?

My son was just born outside Canada and has citizenship from his home country, but we have to wait 6 months for the Canuckistan government to send us his citizenship papers, then we have to wait for his passport. He his due to come to Canada in a month.

Anyone know?

Yes, your son can come to Canada without a return ticket.

Just so you know, you can actually apply for your son's Canadian passport before the citizenship papers come through. With proof of imminent travel and a submitted citizenship certificate app, they will issue him a temporary Canadian passport of limited validity.

Now, do you happen to know if it's better to apply for the passport in the country the child is in (Korea) or Canada (where I am). They suggest both parents and the child be present...which is not possible in our case. And can he enter Canada without the passport and a return ticket provided I am not able to get it to him in time?

I assume your son already has or will have the Korean passport before the flight?

Your son is Canadian, even if he doesn't have the passport and citizenship certificate yet. CBSA won't refuse him entry if he travels on his Korean passport without a return ticket.

If you're going to apply for the Canadian passport, do it in Korea. They suggest both parents be there but I imagine that if your wife has copies of your ID and birth cert, as well as proof of the citizenship certificate application, she won't have issues applying for it.

Just out of curiousity, what makes you say to do it in Korea? I'm wondering as we don't have anyone who can be the gaurantor there, but if she sent the pictures here I could have my mom do it.

Sorry, what I was trying to say was that you should do it in Korea if you want your son to travel here on his Canadian passport.

As I said, if he travels on his Korean passport, he won't be refused entry. You can hold off on applying for his Canadian passport until he and his mother are in Canada.

hello.

I already posted this on another thread but wanna share what I and my husband did for our daughter.

My daughter was born in S. korea so we were same situation as yours .

After she was born, she is automatically Korean citizen and we registered her birth at DONG SAMUSO.

then we applied her Canadian citizenship.

You need birth certificate from Canadian parent(s), your son's Korean birth certificate and forms - I recommend to call embassy before you apply regarding to what kinds of docs you need.

She is still waiting for her citizenship certificate in Canada- normally it takes 6 month according to Canada embassy in S. korea so we forwarded our address to Canada before we left.

To apply passport without citizenship certificate, you need to buy ticket then hand in the receipt with your applications.

So we bought her ticket first(one way) then applied with e- ticket.
- it took 4 weeks to get her passport so make sure you have enough time.

we applied her Korean passport after we received Canadian passport because she has long name (first/middle/ last) so passport office needs reference to do exact same English spelling on her passport. (it took 3days)

your son needs both Canadian and Korean passport when he leave Korea.

Custom at Incheon airport only needed to see our daughter's Korean passport and office at Vancouver asked her Canadian passport only ( I mentioned she has both Korean and Canadian passport though)

We ( I , my husband and our daughter) traveled together so border officer did not ask a lot of question, but I bought her birth certificate from hospital (in English ) and family registration certificate( translated and notarized - I had extra notarized copy)
in case of they asked for some docs regarding to her birth.

p.s We also asked if she can applied her birth certificate and passport in Canada so she can travel with Korean passport.
what they told, she could but we need to explain her situation well at border and might be complicated .

Thanks for the comments everyone. Very helpful.

My wife is actually returning to Canada before our son's Canadian passport would be ready (it takes 20 days and we are still waiting for our Korean family certificate which is supposed to take 10 days).

I've contacted the embassy in Korea and they told me my son can travel on his Korean passport (obviously) and that he won't need the Canadian passport to enter Canada as he is Canadian. The only problem with that is that he hasn't been registered with the Canadian Embassy and has no form of Canadian identification (although we may be able to get it done before he leaves - still waiting for our family certificate from Korea). So without any form of identification I've told my wife to bring copies of his birth certificate, our marriage certificate and my passport in case the immigation officer has their doubts and provided the embassy doesn't get back to me saying that isn't acceptable (can't see why it wouldn't though).

For anyone coming from Korea, FYI, the embassy in Korea is very helpful. Once you start the process you will often be contacted directly by someone at the embassy who will help you with any missed documents. I've usually prefered dealing with them than dealing with passport offices and service centres here in Canada. This time around, we will be doing things here just to relieve the wife from having to do it and the need to have documents forwarded to Canada after she has left.

I was also told by the embassy in Korea that I could write a consent letter on my wife's behalf to make sure she didn't haven any issues with immigration.
