Can my boy-friend sponsor for me as a conjugal partner

Hi

My Boy-friend has got his Canadian PR and is currently working there for 7 months now. Can he sponsor for me as a conjugal partner (along with my right to PR). If he does, i understand that since i am from India, it will take 12 months or more for the process to complete.

1) Is there a 100% possibility that my sponsorship will be approved.
2) If my sponsorship is approved and i move to Canada - Can i start working there immediately
3) Is there any authorized agency which can take care of this sponsorship
4) I already have an express entry profile with 382 CRS score under NOC 2283 - is this gonna help me in anyway?

What are your legal barriers to getting married or becoming common law?

He wont be able to visit me and also our parents don't want us to get married.
Not sure about legal, but we have "barriers" for sure.

It is not considered a legal barrier. To qualify as conjugal a couple has to prove that it was impossible for them to either get married or become common law (live together for 12 months before applying). Usually its gay couples where gay marriages were not allowed in the principal applicants country and they got denied visa to the other countries where they could of got married and can demonstrate it or couples where the principal applicant couldn’t get a divorce because divorce was illegal in their country (like in Philippines) and they couldn’t establish common law either. Those are the legal barriers. There’s no legal barriers for you to get married even if your parents don’t approve it.

So, considering that we got married, can you please address my other questions mentioned in my first thread (if i'm sponsored as a spouse) . Also do you suggest i go ahead with my express entry profile OR wait for me to be sponsored as a spouse.

I don’t know much about express entry streamline, sorry. But when it comes to spousal sponsorship, yes, you can start working immediately once you receive your PR (that’s if you apply Outland, and if you apply inland you can start working even before receiving PR if you apply for OWP along with your application as far as I know). Your express entry profile and your scores are irrelevant when it comes to spousal sponsorship. You will just have to demonstrate that your marriage is genuine. I don’t know about authorized agencies but the majority of people on this forum submit their applications on their own, without a lawyer.

I'd like to know more about how i can apply inland and start working in Canada before i get my PR. And what is an OWP?
Currently, none of the employers want to consider my job application because i don't live in Canada.

No problem! I don’t know much about inland applications since I applied from Outland but as far as I know you can apply for a visitor visa to Canada, get married there and submit your application from inland along with an Open Work Permit (OWP). I think it takes about 3 months to receive this OWP after submitting your application and you’d be able to work while waiting for your PR to be approved. But that’s my understanding how it works and maybe senior members could confirm.

They don’t take as much time to get but you’d have to demonstrate that you have strong ties to your home country and are coming as a genuine visitor with no intention to overstay. The denial rate is high for those visas. There’s a special section on this forum about visitors visa, maybe you’ll find more information on there regarding visitor visas.
