Why make another one for the same thing?
I have never heard of anyone challenging an IELTS score, and certainly not getting the results changed.
If you made a low score, it is because your standard if English was poor when you took the test. If you feel that isn't representative of your standard of English, then my best advice is to simply take another test.
Taking another exam will be quicker and infinitely less costly than mounting legal action against the British Council, and frankly I can't see you have any grounds to challenge them. Your standard of written English seems quite poor from the posts you've made (obviously I can't comment on your standard of spoken English).
So not only for purposes of your PR application, but also to improve your chances of securing a job when you do make it to Canada, I think you'd do well to work on your English, or French.
