Can I sponsor while being overseas? Additional previous sponsorship questions to

Hello,

I've done a search and I can't find anything about this that answers my question. I'm living in South Korea, I have been a citizen of Canada since something like 1988 and am pretty much saving up money to buy a house when I return to Canada (as has been the plan since 2011) and I met my gf here. We're going to get married soon, but I would like to know if I could sponsor her while I am still living here to expedite things, as we would like to start a family very soon.

Yes I believe you can, I'm sure some seniors will correct me if I am wrong.

Yes, Canadian citizens are able to sponsor while living abroad, PR can not.

However you will need to show some proof of your intent to return to Canada and settle once you sponsor your partner. Examples are given in the CIC guides online and the topic is also discussed in quite a few threads on here.

You may NOT sponsor if you…
signed an undertaking for a previous spouse or common-law partner and three years have not elapsed since he or she became a permanent resident and, (other irrelevant things here)

I did sponsor my first wife (US citizen) but the marriage fell apart and she went home before anything was finalized. She got a letter in the mail a year later saying she had been approved for permanent residence, but at that point we had divorced amicably (no dependents and we were both pretty broke college kids) and she did not pursue it.

It has been over three years since we applied. Is there any severe danger in this course of action?

You should have told CIC about the change in circumstances and they wouldn't have issued the PR. I'm not sure how this will now impact your new application.

You imply by "she did not pursue it" that she never became a "landed immigrant". In which case, the sponsorship undertaking never came into effect. This will not be an impediment..

Yeah she just moved back to the states and left me with some legal troubles (a Conditional Discharge for a 266) but that has been over 5 years now.

Damn plot thickens!

How will THAT affect my sponsorship? Curiously, the incident happened before we got married and had most of the paperwork filled out for the sponsorship. They allowed the sponsorship to continue.

So, what should I be tackling now? I have no criminal record (or else I wouldn't even be in Korea to begin with - and I've been here on two separate work visas spanning since Dec 2011) but will it show up since my ex was my spouse (but not at the time) - So confused.

266 is domestic assult, therefore there may be a record, at least in Canada which may cause issues when sponsoring. Other members well versed in criminality can answer you in detail.
