I just recently sponsored my husband to come to Canada and he was finally approved last month. Originally we included his children in the application as non-accompanying dependents as their mother was not willing to let us bring them to Canada and created many problems for us every step of the way.

Now out of the blue, their mother has run off with a new man and abandoned their son. Police reports have been made and we are dealing with lawyers in his country right now however I need to know once we get full-custody if we can even sponsor his son anymore. My husband will only have had his permanent residency for a couple of months and from what I have read he needs to have had it for at least 5 years before being able to sponsor his children. Am I able to sponsor my step-son if that is the case?

You can't sponsor your step-son but your husband can. The 5 year bar applies if he wanted to sponsor a spouse, not dependent children.

This assumes that you had the child medically examined etc as part of the husband's PR application.
