CAN I FLAGPOLE TO RESTORE STATUS AND APPLY FOR SOWP?

I applied for renewal of my open work permit on 24 January 2024 before the expiry date of 29 January 2024. I got acknowledgement from IRCC that i continue working till 20 July 2024 pending approval of my Open work permit. My spouse also applied for her PGWP which was approved on 27 February 2024. I got a refusal letter dated 7 July from IRCC which also stated that my status expires on July 7, 2024. The basis of refusal was that my spouse is not working. However, my wife got a full time permanent job in March and she has started working since then, but I made a mistake of not including this details in my application because i applied before she secured the job. I have re-applied for the Open Work Permit together with restoration of status online. Since i cannot work for now and considering the waiting time, can i flagpole and later withdraw the online application after getting the Open Work Permit? I need your advice because i do not want to lose my job if i stay away for a long time, also living without working will be difficult as there are bills to pay. Thank you for your swift response.

You should absolutely not flagpole while out of status. This is very risky. Remain in Canada and wait for restoration.

I also need clarification on the specification of employment letter attached as proof of working for my spouse. Must it state the NOC and also specify the job duties? Can one use an employment letter that only states the Position Occupied, wage, and also stating the job to be full time permanent and attach pay slips?

From the IRCC site:
For most open work permit holders, such as those under the PGWP program or International Experience Canada, the proof should be a letter from the principal foreign worker’s current employer that shows

  • their employment details
  • their occupation
  • a description of their duties
  • the NOC or TEER category their job is classified under or a copy of the letter of offer of employment
