Hi everyone,
My case is a little complicated. Here's the thing.
I applied outside Canada reunion in 2013. Due to some unknown reason, like background check, my case still being processed in HongKong. And I'm in Canada right now waiting for my case done. But in my opinion, it is far from certain of final approval by CIC.
So, is there any possibility that I withdraw my case and apply inside Canada reunion again? I need owp to work badly and health insurance for delivering my baby next year.
Is there any waiting period? Can my husband spouse me again right after the withdraw?
Thanks a lot.

What is your current status in Canada? Are you a visitor, have you been maintaining your status? You could withdraw your application and re-submit an in-land application, but there's no saying how long that process could take. You'd have to get all your documents together again, police certificate, medical exam and pay the fees again. After that, it could be a couple months until OWP and 3 months from then would you have provincial insurance (OHIP, specifically, this timeline might vary slightly between provinces). It might be many months before you're able to work and even longer until you have health insurance.

Hi there,

I'm inland, yes you can withdraw the outland and re-apply inland. BUT as the previous poster pointed out ALL you're evidence needs to be re-submitted and it ALL has to be current...medical, police checks, etc etc. Regarding the work-permit...it takes 4 months from when the application is received by CIC for the work permit to be issued (you must apply with you're Permanent Residency application, both in the same envelope), you mentioned you are pregnant, if you are in you're first month, that means you would not be entitled to any prenatal care until the 5th month at the earliest (and that would only be in a very benevolent province, like Alberta, who gives health coverage straight away with work permits). In somewhere like ontario you need to work full-time prior to coverage..and with you then being 5 months pregnant, who would hire you?.....Seriously.

Also it should be stated you must be in valid status to get the early work permit (have a valid visa), in other words if you are in Canada on implied status then the earliest you can get a work permit inland is when AIP is issued...about 19 months.

Personally I would start chasing up my current application and see exactly at what stage it is at before making any other decisions.

Not true. Only those that have lost their status need to wait for AIP to then be eligible for the regular OWP.

Implied Status still counts as valid status for the new OWP.

I would follow up on current case and see why it's taking so long, maybe get an MP to look into, yes you can withdraw and reapply like stated above but CIC will look at your case a lot more closely because it was withdrawn and submitted again, inland applications normally takes longer than Outland you might be close to the end ask for an update on your case

Thanks a million times for all the replies above.
I'll think carefully before withdrawing my case.
I had already contacted MP in my region last year. They checked my case with HongKong office and told me that my case is supposed to complete in early this year. But unfortunately I'm still waiting.
I really don't know what else I can do. Two and a half years have passed since CIC started the background check.
Well, thanks again guys.
