Hello everyone,

After facing life threatening conditions, I had to come to Canada and apply as Refugee claimant with my family.
After application, we had bad litigation process and we were rejected and I applied for the appeal and still waiting for more than 1 year.
The file of my wife and my kids is separated and directly sent to Federal Court and they rejected also.
At the end we could apply to Humanitarian Agency, also PRA process is started together for them.
So now we are waiting the results.
While we are waiting we are always anxious about the final decision.
It is really tough issue and God helps all people in this situation.
At this point i really need advice.
Should I wait the results or should I take proactive action?
I am IT guy and and already I had more than 1 year Canada work experience at private company.
Is it logical to apply provincial nominee programs ? or what else can we do?
I heard many alternatives in different provinces.
Especially some of them accept as international student under 1 year university study +1 year work program and then let you apply to provincial nominee program (PNP).
Is this possible for refugee claimants and what are the risks?
All these are just for protecting my family and not to be deported to back home which is hell nowadays.

I appreciate if I can get valuable advises.

As a failed refugee claimant, you are not eligible to apply for PNP or any other programs because you are without status in Canada. Unfortunately, there isn't much you can do aside from waiting patiently for the outcome of your H&C application.

You cannot apply through PNP as a failed refugee claimant. You'll need to hope the outcomes of the Humanitarian or PRRA process are positive.

If you have IT skills you could also see if you can get a job in another country that could eventually lead to PR either in that country or back in Canada.

Sorry for lack of my English. To be on the same page, do you mean I have to find a new job in another country then retrieve back my all asylum application, take back our passports and move that country and then apply to PR to Canada via express entry?If it is so, In another country they can check my background and ask what i did my last 2 year and they can understand I was refugee and they deport me too?

If you have good IT skills you may be able to find a job in another stable country. Just throwing out other options. In your current situation you have very little options. Any form of economic immigration is out in Canada. If you have really good IT skills that may lead to economic immigration opportunities elsewhere.

You'll need to declare your Canadian immigration history (including the failed refugee claim) when you apply for the work permit. You'll need to obtain an approved work permit before you can travel to that new country.

My situation is very difficult I had applied AYSLUM in USA but due to delayed in interview we left the country but now in my home country my friend in calling my family on visiting so can we take asylum there or we are eligible to do so my case was closed in USA pls help

It would be extremely difficult to get a VISA to visit Canada, based upon your past history in the United States. The two countries share immigration data. If you claimed asylum in the US, why would you leave to go back to your home country, (all because of a delayed interview,) where presumably this is where you claimed asylum from ? And you mention it was because of a delayed interview, then that the case was closed, does not make sense.

If you can safely go back to your home country, you probably don't have an asylum claim.
