Can I apply for renewal of PR being outside Canada

Hello,
I would appreciate the answers to my questions, because I have searched the forum and didn't find question matching my problem.

I got PR in 2008 June and stayed, worked and lived in Canada continously untill 2011 August. That means I have already satisfied residiency requirements.
Since 2011 I am staying in Europe (in my country of citizenship) and I have declared my address there because of health insurance issues.
My PR card expires in 2013 June and I want to ask:
1. Can I fullfill all documents for renewal from Europe and mail them to the office in Canada? If that's possible, may I stay in Europe and ask my family in Canada to pick up a card from mail box and send it to me.

2. If above mentioned is not possible, lets say I come to Canada, apply for renewal of PR and can leave again? And again ask my relatives to pick up card from mail box and send it to me.

The application has to be mailed from Canada. So you'll have to go with option #2.

Yes, your relatives can mail the card to you once it's ready. Note that sometimes CIC will ask you to come to the office in person to pick up the card.

But if lets say I fill all the forms, print them, sign and send to my family in Canada, and they send it to the immigration office. Technically it should work. But I am concerned if CIC can check that I had crossed Canadian border and didnt come back the day the application was sent?

Is there any other way to apply for PR being outside? Maybe CIC will consider me residing in Canada if I give a proof of home address in Canada, proof of some property, or etc.? Please advise

There is a clause about how the application must originate in Canada but there is also a clause stating that applicant can not be denied on the sole basis that they themselves are not in Canada. Therefore, you can mail your documents to your family and ask them to mail them in for you. Write a cover letter stating that you do not live in Canada at the moment but your family is a secure mailing address for you.

It is possible that you will be asked to pick up your PR card in person and if that happens, you will have to go yourself and get it.

Also keep in mind that getting a new PR card does not allow you to stay outside for a new period of 3/5 years counting from your PR card renewal. It is a rolling 5 year period that is considered so if you left in August 2011, you must return by August 2014 at the latest and then you'd then have to stay for 2 years straight in order to meet your residency obligation.

R56(2) states clearly that a PR card application must be made in Canada. Furthermore, the card must be delivered in person to each applicant, pursuant to R58(3), and be picked up within 180 days of the person receiving notification that it is ready for collection. This enhances the integrity of the application process, allowing the local office to contact the client to review documentation and assess residency issues in person. However, it is recognized that the Regulations do not specify physical presence in Canada for purposes of filing a PR card application. Applications cannot be refused solely on the basis of evidence that the applicant was not in Canada when the application was filed. However, applicants are expected to provide an address in Canada where they may be contacted to provide additional information or to present themselves in person for the purposes of reviewing either identification or eligibility for the PR card. The CPC may refer a case to a local CIC if all or part of the application originated from outside Canada, and if there are questions as to the client’s identity, status or residency history, or the authenticity of the documentation. Clients must report in person to pick up their card in Canada, in accordance with R58(3).

Application for PR Card

Dear Leon,

I'm writing in behalf of a friend who has requested me to consult you about his desire to apply for PR Card.
His name is Alvin from Philippines and currently working as a Welder in BC, Canada. He is holding a working permit with multiple entries, with following number of months of stay inside Canada so far.
- May 2009 up to Feb 2011 (1 year and 8 months), June 2010 he's in Philippines on vacation.
- May 2012 up to present (Feb 2013) (9 months)

Considering his category as skilled worker and the number of months he has stayed so far inside Canada, is he eligible to apply for a PR Card?

He can apply for PR under Canadian experience class based on having more than 12 months skilled working experience in Canada in the past 3 years, see http://www.cic.gc.ca/english/immigrate/cec/apply-who.asp but he also needs to pass an English test.

It is also possible that his employer could sponsor him under BC PNP.
