Can I apply for a PRTD if my PR card is still valid?

Hei,

I have a PR card valid until the beginning of the coming December. I am accompanying my Canadian spouse abroad all the time.

We are traveling to Canada during Christmas, and hopefully I can renew my PR card during our stay. But my PR card will expire before our planned travel.

My question is whether I can apply for a PRTD now to prepare for this trip.

Thanks.

Did you ever move to Canada?

Hei,

We did not. We have been living abroad after the landing. I thought I might still be able to apply for PRTD and renew my PR card because I am accompanying my Canadian spouse.
You can try applying if you wish. If IRCC wishes to, they could dispute/refuse on basis that you never really settled in Canada at all and hence there was no 'accompanying' as never any actual move / travel out of Canada on which to 'accompany.'

Chances perhaps higher because your landing involved no residing in Canada, and likely more so if you just returned to country of origin (which it sounds like).

But no-one can say for sure.

Update here. I received IRCC request for passport to say the decision has been made for my PRTD. I hope it is a positive sign.

Would seem to indicate as such, since they've requested the passport. ;)

Hello @Paean ,

I am in the same situation , My PR card is expiring in Mid March this year and due to my personal circumstances , I can only travel in April. I am planning to apply for PRTD in advance right now like you did.

Request your help in letting me know about below :

1) IMM5444 - Did you choose your situation as " Apply for PRTD as I do not have Valid PR card " ?

2) Did you provide any letter of explanation of your situation ?

I am meeting my Residency obligations and will provide them necessary documents but am skeptic about above , if you can please let me know what you did in your case , Thanks a lot in Advance !

I replied in the private message since I also received in a private message, but copying my response here for future reference.

I do not remember for sure and I could not see my application anymore after submission. I probably chose that if that was only way to go forward for the application.

2) Did you provide any letter of explanation of your situation ?

Yes. Because IRCC gave me instruction to do so (I inquired online and received response within 4 weeks) and in the letter of explanation, I emphasized that I applied for PRTD following instruction from IRCC (without quoting the exact text) for the purpose of future travel (my PR card will expire) and PR card renewal.

Have you applied for a pr card renewal? Apply now and a good chance you'd have the new one back before end March.

Yes. I have applied for a PR card renewal during Christmas visit, while I have no idea when/whether I will get a new one. I am glad I made the Christmas visit successfully with PRTD since we made mistake to book the flight much earlier.

I was actually inquiring of @AGGG - although they said in same situation as yours, I find more often than not those 'same situations' are often completely different.

Hi AGGG,

I'm in a really similar situation to you, my PR card is valid until July 2025. And I need to travel to Canada in September. I'd like to apply for a PTRD in advance as well. I am meeting the residency obligations.

I'd love to know if you applied and if this was successful?

Any help you are able to give is greatly appreciated! Thanks
