Can Husband who is a Canadian Citizen who lives in US sponsor his wife now?

Hello everyone

I am very new to this site and its a bundle of great information and I was really hoping for some help! My husband is Canadian Citizen and I am a US Citizen and we have been married for almost 9 years living in the US. We recently decided to move back to Canada to be near his family and friends. Going though all this paperwork can get a little crazy so I have a few questions if you all dont mind. We have printed out The Document Checklist - sponsor, Sponsor Questionnaire, Sponsorship Evaluation, and the application to sponsor. Our few questions: Can my husband while working in the US at present time sponsor me? He has had a few job phone interviews and knows a lot of contacts up in Canada so I dont think its going to be a big deal for him to find work but currently he is working in US. It states in the Questionnaire employment, does he put is current employment here in the US? Also, there are some questions on this document checklist - sponsor that I have some questions if you all dont mind.. in #18 it states Proof of Employment, you will need to provide an orig letter from your current employer for salary and hours worked per week, is this is current employer here in the US? Also, it seems I will need to have finger prints and a Medical exam, can I have this done here in the US or do I have that done in Canada? Does all this need to be sent with the application to sponsor me together? Reading this checklist makes it seem more confusing that I think it might be, I would really appreciate a list of what is needed to just start the application for sponsorship for myself, that would be more helpful and simple I think LOL :eek: Thank you all for your patience and help! Yes he can start the sponsorship process now. Include current US employment evidence. We are in the same position but in the UK. We submitted everything for Sponsor and Applicant together. You can have your medical a in the US at a designated doctor.

He will need to state what his plans are for moving back to Canada and include any evidence he has to show this.

This is corret. There are two sets of forms. One concentrates mainly on the sponsor (Canadian citizen) and the other on the applicant (you). Because he is a Canadian citizen, he can sponsor you. But when he is filling out his sponsor forms, one of the questions will ask "Do you live exclusively outside of Canada?" He does so will have to say yes. He can ONLY sponsor you if he can PROVE that he intends to move back to Canada when you receive your PR. The guide states that proof could be things like a job offer in Canada, a home in Canada, etc. Most people cannot get a job offer THAT far in advance. So what most people do, is write a DETAILED plan of how he will re-establish himself in Canada and how he will be able to support you and how you two will build a life in Canada. Suggestions are for him to talk about where he plans to live, how he intends to pay for his, mentioning why he wants to go back (as you said, friends and family), how you will get a job, if you both can't find work how you will be supported (family offer to help), etc. He basically has to convince the officer that upon PR he will have a plan to establish a new, SUCCESSFUL, life with you back in Canada. After he does this, he will be approved to sponsor and your application will proceed to stage 2, where they examine the applicant and your relationship to make sure it's genuine.

That could including savings here we have as well correct? 401K etc for both I am hoping too, should we include this in the sponsor pack as well? Feel we need to get this off as soon as possible so we can start on the next phase. If I remember right almost 10 years ago we did this for my husband but the other way around for him to come here in the US, easier part was he came down transferring though his old company. Sounds like you all are well on your way too and its so nice to have the support here to make sure we are filing the correct forms at the correct time!

Not sure if I'm reading that you plan to send the Sponsor application by itself?... You need to submit need submit the Sponsor application (checklist, forms and supporting documents) AND the Applicant application (checklist for applicant from the US, forms and supporting documents for you), along with FBI records check and proof of medical exam, ALL at the same time. If you don't the application will be returned to you as incomplete.

wow I am really glad you responded as I didnt know that I needed to submit a medical form and FBI forms too along with my application to be a PR? I am reading they need a copy of his passport, my passport, our marriage certificate. I guess I would go down to the police station and ask them to fingerprint me? I have never done anything like this before. So there is more then just his application for his sponsor request, you can send my request for PR too? Am I understanding that correct? or is it your saying you need your checklist, app for his sponsor , the eval , questionnaire and the docs of my fingerprints, marriage certificate and his letter of why we want to return and his ability to get a job, our savings and 401ks etc? sorry if I am confused :D

Yes, you can include proof of funds including savings and attach it to your plan to show how you will have funds to re-settle in Canada.

There are two separate things all together. Forms for the sponsor (Canadian) and forms for the applicant (American). There are separate guides (which are also located on this webpage) to tell you exactly how to do each form and what to include. There are also checklists which you MUST include and must have all the items included in your package.

I suggest you read BOTH guides as you do the forms to make sure you don't miss anything. All of the forms and guides are found at the website I gave you.

Part 3 for sponsorship of spouse I went down to US and it asks you which area if needed interview do you want and they list all US ... I dont see one for Canada maybe there isnt one in that 3rd part

If you are called for an interview it will be in the US. Pick the office closest to where you live in the States. I believe from your original post you are still living in the States? You will not be able to move to Canada while your application is being processed, but if your husband gets work and moves to Canada and you are there visiting him, and they want an interview you will need to go to whatever US office you have chosen as this preference.

Yes I guess I wasnt thinking of my husband leaving me here and having to go alone.. which would be the best do you think? Pack everything up and have him take the rental truck with our personal things or leave them here and have him come down and we do it when I am able to come? I guess I wasnt sure how long this would take.. Being away from each other sure isnt what you expect.. I guess its what you and your husband decide but wondered what you all did?

I did make my first move besides print everything I could think I would need, I called the doctor and left a message for the medical exam, werid tho it seemed like it was his personal phone # and had to leave a message, any thoughts on how fast appts take to get?
